What the inspector wrote

LPA conducted interviews and reviewed records on 10/27,10/28, and 11/01/2021. LPA conducted interviews with Staff #1 (S1), #2 (S2), #3 (S3), #4 (S4), #5 (S5), and Child #2 (C2), #3 (C3), #4 (C4), #5 (C5), #6 (C6). S1, S2, S3, and S5 stated that the children have not engaged in inappropriate behavior and staff did not observed anything inappropriate take place at the facility. During the course of interviews, S2 stated that child identified in the complaint was not present when the alleged touching or hitting took place. S2 also stated that at no time did C1 (alleged victim) disclose any wrongdoing by C2. When interviewed, C2 was unable to identify who C1 was. C5 and C6 stated that they had not been witness to C1 getting hurt by other children in care. C6 stated that whenever children try to play with C1, C1 would tell the teacher that the children were hurting C1 when they were not. Based on records reviewed, C2 was not present on one of the alleged days. Based on the evidence obtained during the course of the investigation through interviews and records reviewed, the evidence does not support, nor disprove the above allegation that staff did not prevent day care children from engaging in inappropriate behavior. Therefore, the allegation has been determined to be unsubstantiated. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred. Child sustained injury while in care- Complainant alleged that C1 was hit with toys by C2 on two separate days. LPA was unable to interview complainant as complaint was anonymous. LPA conducted interviews and reviewed records. LPA conducted interviews with Staff #1 (S1), #2 (S2), #3 (S3), #4 (S4), #5 (S5), and Child #2 (C2), #3 (C3), #4 (C4), #5 (C5), #6 (C6). No disclosures by staff of C1 being injured nor were there any injury reports completed for C1’s alleged injury. C5 and C6 stated that they had not been witness to C1 getting hurt by other children in care. C6 stated that whenever children try to play with C1, C1 would tell the teacher that the children were hurting C1 when they were not. Based on records reviewed, C2 was not present on one of the alleged days. Based on the evidence obtained during the course of the investigation through interviews and records reviewed, the evidence does not support, nor disprove the above allegation that child sustained injury while in care. Page 2 of 3 Therefore, the allegation has been determined to be unsubstantiated. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred. The Notice of Site Visit (LIC 9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative.
