What the inspector wrote

Information from the complainant indicates that facility uses inappropriate form of punishment. It was reported that staff handles children roughly and that they yell at the children in care. Director made no disclosures regarding the above allegations. Discipline policy is to have children sit off to the side and for staff to talk it through with the children due to their age. Staff interviews made no disclosures about the above allegations. Children interviews made no disclosures about the above allegations. Parent interviews made no disclosures about the above allegations. Based upon the evidence as presented above, this agency has investigated the allegations above and has determined that the allegation is Unsubstantiated. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is unsubstantiated. No deficiencies are being cited for the allegations listed above Exit interview was conducted with Director Toni Espino, at 11:55am, and copy of report was provided. The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. REPORT ENDS PAGE 2 of 2 Information from the complainant indicates that a child was left unattended in a classroom. During inspection, LPA received two written statements from staff members who disclosed that a child was left in the classroom while the rest of the group was outside. Incident took place on 11/19/2021 during their thanksgiving program in the morning. Director states that during their thanksgiving program at the facility on 11/19/2021, during a transition from classroom to outside, a child was accidentally left in the classroom unattended in Room 2 when another child ran off and the staff ran after the running child. Children made no disclosures regarding the above allegation. Interview with Staff #7 disclosed that during the thanksgiving program, a child was left alone in the classroom because another staff member chased after a child who was running away from the group, corroborating Director’s statement. The staff member brought the child who ran, back to the group and returned back to the Room 2 to get the child who was left unattended in a high chair. Parent interviews made no disclosures regarding the above allegation Based on interviews which were conducted and record review of the written statements, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 Chapter 1 101229), are being cited on attached deficiencies page. Please refer to attached 9099D for documentation of deficiencies. Upon receipt of this report, the Licensee shall post the Notice of Site visit and any licensing report documenting a type “A” deficiency. The report and the Notice of Site visit shall be posted for 30 consecutive days. Failure to maintain posting as required, will result in an immediate $100 civil penalty. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. Licensee was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form during this visit. A copy of the Parent Notification Requirements was also provided to the licensee. Exit interview was conducted with Director Toni Espino, at 11:55am, including a copy of report. This poses a potential risk to the health, safety, and personal rights of children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    Responsibility of Providing Care and SupervisionNo child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.This requirement was not met as evidenced by: Based on interview and record review, it was disclosed by 3 of 7 staff, that a child was left unattended in a classroom without supervision on 11/19/2021. This posed an immediate risk to the health, safety, and personal rights of child in care.
