What the inspector wrote

During the investigation, LPA Lee did observe that this side door is not locked and can be opened by pressing the lever on the right side of the door from the inside. The Director stated that the facility was told by the fire department that this particular exit cannot be locked to prevent it from being a fire hazard. Based on information obtained during interviews, the child most likely wandered away when the children were all using the restroom as a classroom with the teacher. LPA Lee did observe that the bathroom is closer to the side exit mentioned then the main door. Even though the exit was not latched or locked to comply with the fire department, the fact that a child in care wandered away from the facility shows a lack of adequate supervision from the facility. This is an immediate risk to children in care. Based on the information obtained during the investigation, the preponderance of evidence standard has been met, therefore the allegation of not providing adequate supervision to child in care is found to be Substantiated. California Code of Regulations,(Title 22, Division 12 & Chapter Number 6), are being cited on the attached LIC 9099D. Upon receipt of this report, the licensee shall post ANY licensing report documenting a type “A” citation. This must remain posted for 30 days during hours of operation. In addition to posting this report, the licensee will also provide copies to the parents of the children in care for up to one year. A copy of the LIC 9224 - Acknowledgement of Receipt of Licensing Reports was provided. Exit interview conducted with Director Sakuntala Abeyasekera. Appeal rights discussed and explained. The notice of site inspection and all pages of this report must be posted for a period of 30 days during hours of operation. Failure to maintain documents for 30 days during business hours will result in a civil penalty of $100.00 dollars.

    REPORTING REQUIREMENTS

    Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified . in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. This requirment was not met when the Director stated she forgot to report an incident that occurred at the facility on 10/20/2021 to the department within 24 hours. This is a pontential risk to children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirment was not met as evidenced by a child in care wandering away from the facility on 10/20/2021 due lack of adequate supervison. This is an immediete risk to children in care.
