What the inspector wrote

On 09/26/24 Licensing Program Analyst (LPA) Mary Silva conducted an unannounced Case Management-Other inspection for the purpose of reviewing personnel file for staff #4. Upon arrival at 1:55pm LPA met with Supervisor Vanessa Burgueno and Principal Christian Aleman, to whom the purpose of the inspection was explained. LPA was provided tour of the facility. Census was taken there were a total of 45 children with 12 staff members. During today's inspection, LPA discussed with Supervisor and Principal the requirement for personnel records to be available for review by licensing agency. On 05/14/2024, LPA requested to view personnel file for staff #4 and was informed by director of personnel services staff files that maintain confidential information were not available for review. On this day, 09/26/24 Licensing staff was informed principal a request to review personnel files would need to be granted by assistant superintendent. Facility maintains two separate files in the center, one file provides staff qualifications and licensing forms, and the second file contains districts forms, evaluations, and other confidential information. LPA obtained a written declaration from principal, stating personnel file for staff #4 or any staff would need to be approved by assistant superintendent. Based on Licensing staff observations, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Supervisor Vanessa Burgueno. Appeal rights and copy of report was provided.

Based on observations, the facility did not comply with the section cited above as evidenced by department, facility did not grant Licensing staff access to view personnel file for staff #4, which poses a potentialrisk of the health, safety, and personal rights of children in care.
