What the inspector wrote

Page 2 Allegation states that children's Personal rights (Children engaged in inappropriate interactions while in care ) were violated while in care. During the course of the investigation, interviews were conducted with the licensees who stated the children have never been left unattended at all and the two children who were alleged to have had inappropriate interactions never slept next to each other at all and the alleged date of the incident, the two children were not in care together on that date. LPA observed the space where the children nap and it is an open space with short half walls, which the inside of the room is visible from all the areas around the room which are the kitchen, living room and back yard. There is a glass sliding door that leads to the back yard from the napping room. (Photos taken) Interview was conducted with child #2 who is not very verbal but did understand what a kiss was and stated he only gets kisses from his mom. The child showed the LPA where he gets kisses and pointed to his lips and cheeks on his face. Interview conducted with child #2 by the local police department was not successful as the child is not very verbal and the child could not comprehend what was asked to him by the police. No police report was created. Interviews of children also validated what was said regarding the children sleep on separate sides of the room and they did not always use blankets. It was stated that they some times play doctor and house and when they play doctor they give shorts on the arm. Licensee stated children play doctor with the dolls and do not use the play doctor toys on each other. It was stated that child #7 was consistent with her story about inappropriate interactions in the day care, however the child had several issues with inappropriate interactions at home as well and it was undetermined where those actions came from. Based upon interviews conducted, it is unclear whether child #2 and child #7 touched each other on their private area or elsewhere. This agency has investigated the complaint alleging that there was a violation of "Responsibility for Providing Care and Supervision" and "Personal Rights." The complaint alleged that " Children engaged in inappropriate interactions while in care ". The allegation has been determined to be Unsubstantiated. An exit interview was conducted with Awny Ibrahim & Mariam Shokry. Appeal rights were explained and provided. The Notice of Site Visit was issued and must be posted for 30 days failure to do so will result in an immediate civil penalty of $100.
