What the inspector wrote
At 8:30 am Licensing Program Analysts (LPA) Roxana Lopez conducted an unannounced required 1 year inspection to the above facility. LPA met with Guadalupe Ornelas, Licensee who guided analysts on a tour of the facility. Also present during this inspection, was two adult children. Per Licensee, there are 5 children that are currently enrolled. A current children\342\200\231s roster was available for review. There were 0 children present upon arrival.
The licensee states that 4 adults and 0 children currently live in the home. Per Licensee, she currently does not have an assistant because she only has 5 children enrolled. All adults present in the home have obtained a criminal record clearance or exemption prior to working, residing or volunteering in the licensed child care home. Licensee states that there are no firearms stored in the home.
This is a one-story home which consists of 4 bedrooms, 2 bathrooms, kitchen, dining room, living room, garage, front yard and backyard divided in three (fenced). The children use the bathroom in the hallway and master bedroom, living room, master bedroom and dining room areas. LPA observed that there is a fireplace in the living room and it is barricaded. Per Licensee, areas off limits to children and parents include: 3 bedrooms, kitchen, front yard, 2 sides of the backyard(left side of the yard and back of the yard which is divided by a locked fenced) and garage. Areas off limits were observed to be locked and inaccessible for children in care.
All areas identified on the facility sketch that are accessible for children to use were inspected for safety, comfort, and cleanliness. There is telephone service via a
cellphone
that is used and the cellphone stays at the facility during operation hours. There is ventilation and heating (central). The following was observed and reviewed during this inspection.

Detergents, cleaning compounds, medications, and other items which could pose a danger to children were observed to be inaccessible to children in care. LPA observed cleaning supplies in the master bathroom, licensee removed cleaning supplies and placed them in a locked cabinet. Poisons are locked in a cabinet in the garage. The restroom that children use was observed to be safe and sanitary.
Fireplaces and open face heaters are inaccessible to children. The valve on the required 2A 10BC fire extinguisher indicates fully charged and was serviced on 06/22/2020, as indicated on service tag. Smoke and carbon monoxide detectors were tested and are operable. All homes shall conduct fire and disaster drills at least once every six months, and document the date and time of each drill. At 8:40 am LPA observed that the last drill documented was conducted on 5/2020.
Emergency Disaster Plan, Parent\342\200\231s Rights Poster and the Facility License were observed to be posted on a wall by the entrance.
The home is observed to be clean and orderly. There are toys available for children. Appropriate sleeping arrangements were observed. LPA observed cots, 1 play pen and 1 crib.
Licensee states that she is currently caring for infants. LPA advised the licensee to sleep infants where they can always be directly supervised and advised the licensee against sleeping infants in a separate room. Licensee states that infants sleep in the dining room.
LPA did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, and/or any other item that fall into these categories are not permitted in a family child care facility. At 9:00am LPA did observe a trampoline in the off limit back yard area which is fenced and locked.
Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home.
Currently, children are using the back yard for outdoor play time. LPA observed the backyard to be divided in three sections. The left side and the back of the yard are fence and locked making it inaccessible for the children in care. LPA observed that the outdoor yard has toys and other materials for children to play with. did observed two grills and toys with spider webs that can pose a danger to children on the outdoor yard. During the inspection Licensee had her son remove the grills and clean the toys.
There are 4 cats, two dogs, 3 birds and a fish tank on the premises. Per Licensee, the cats, dogs and birds are kept in the off limit areas(garage, room and side of the yard) during operating areas.
The licensee is observed to be operating within the license capacity limitations.
At 9:36 am
children\342\200\231s records were reviewed, including emergency information. LPA observed that Child 5 is missing complete file.
The licensee has completed training on preventive health practices including Pediatric First Aid and CPR. The licensee's Pediatric First Aid and CPR expires on
6/22/2021.
Per licensee, she will enroll in a course and send proof off new CPR.
There are first aid supplies available.
LPA observed that the Licensee and assistant does have proof of immunization record and the Mandated Reporter AB 1207 compliant Child Care Training Certificate on file with expiration date of 6/11/22.
Incidental Medical Services (IMS)

The licensee states that she will provide IMS. Per licensee, there are no children enrolled that require IMS at this time.

The following was discussed with the Licensee:

Individuals who are 18 years of age or older living in the home must obtain a criminal record clearance. Individuals within one month of their 18th birthday must be fingerprinted immediately. Civil Penalties will be assessed if not in compliance.

In the absence of the licensee a qualified adult must be present supervising the children; a qualified adult is an individual who has a valid and current Pediatric First Aid and CPR training, Immunizations (TDAP, MMR, Influenza), mandated reporter training and a valid criminal record clearance associated to the facility license.

Annual fees must be paid promptly and by the due date or a late fee shall be assessed and/or the License may be terminated.

The fire extinguisher type 2A-10BC must be serviced annually or as often as necessary. Smoke and carbon monoxide detectors should be checked and batteries replaced as needed.

Reporting Requirements: Changes should be reported to the Department as soon as they occur such as construction, remodeling, telephone number changes and/or if you move from your home.

Reporting Requirements: Any unusual incidents or injuries must be reported to the Department within 24 hours via telephone and within seven (7) days in writing.

All adults living and working in the home shall be made of aware of the Department\342\200\231s right to inspection the home, which includes, but is not limited to the right to enter the home when children are being cared for, interview children and adults and review documentation.

The facility license number must be on all advertisements, publications or announcements with the intent to attract clients.

Immunization Requirement: H&S 1597.622

Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. The licensee and all adults working with children have proof of immunizations.

Beginning January 1, 2018, all licensed providers, applicants, directors and employees to complete training as specified on mandated reporter duties. Training is available at:

LPA consulted with applicant regarding COVID-19 health and safety guidelines on this date. LPA Lopez did observed COVID-19 postings out on the front porch along with hand sanitizer for the parents. COVID-19 postings were observed in the restrooms and through out the facility for children in care to see.
During this inspection LPA discussed PIN 20-06 CCP, Social and Physical Distancing Guidance And Healthy Practices For Child Care Facilities In Response To The Global Coronavirus (COVID-19) Pandemic Written In Collaboration With The California Department Of Education.
Based on the LPA\342\200\231s observations and records review, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children\342\200\231s health & safety.
The Notice of Site Visit (LIC 9213) \342\200\223 must remain posted for
30 days
during the hours of operation after each site visit made by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
