Inspector’s narrative

What the inspector wrote

Out of fifty-two children, only 11 children brought their masks. There was no disclosure as to how the center handle the situation when children come without their masks. This center was licensed to serve children age two to five years old. Per the California Department of Public Health (CDPH) "Guidance for the Use of Face Coverings" issued on 07/28/21, all persons, regardless of vaccination status are required to wear masks indoors, including K-12 schools, childcare and other youth settings because they are currently ineligible for vaccines and are therefore unvaccinated. This same guidance stated that, "In general, people do not need to wear masks when outdoors and that persons younger than two years old are exempt from wearing masks due to the risk of suffocation.” A copy of the guidance from CDPH was provided during this visit. Based on LPA’s observation, interviews, and record review, the preponderance of the evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 is being cited on the attached LIC9099-D. The notice of site visit was posted where the parent/guardian of children enter and exit the facility. This notice shall remain posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty. Exit interview conducted with Ms. Haslett during which appeal rights were explained. A copy of the Appeal Rights and report provided.

To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement is not met as evidenced by: On 9/16/2021, LPA observed during the facility tour that there were 6 out of 52 children present wearing their masks indoor. Only 11 children brought their masks when postings have indicated that children is to wear mask. This is not in line with CA Department of Public Health requirement for children to wear mask indoor in child care setting. This poses a potential health and safety risk to the children in care.
