What the inspector wrote

On 2/25/2025 at 9:30 am an unannounced Case Management – Deficiency inspection was conducted by Licensing Program Analyst (LPA) Carolyn Tuba who was there to conduct a separate investigation visit. LPA entered facility through the main gate and met with staff, Arianna Gomez who informed LPA that the Director, Maria Flores was currently not here. Director was called and she arrived at approximately 10:30 am. LPA took a census of 4 children in care with 2 staff members. During the visit at approximately 9:40 am. LPA was checking clearances for staff that was present and found that an individual was not on the Guardian Employee Clearance Roster. LPA called the Department to confirm and found there are no fingerprints are file for the individual. LPA had asked staff if they were a volunteer or staff member. The individual stated that they are from the American Job Center and have been working at the facility for the last 2 weeks, Monday – Friday, 9 am to 5 pm, which exceeds the volunteer hours of 16 per week. LPA had asked if they are ever left alone with the children in care, and they confirmed they are not. LPA asked if they have Child Development units at this time and the individual stated they do not. The individual was asked to leave the premises and may not return until they have fingerprint clearance. The other staff member who was working with the uncleared individual was able to be left alone because they were working within the allowed ratio of children (1 staff -12 children) and were fully qualified. LPA also advised the Director that the Individual must have immunization (Tdap, MMR, TB & influenza, or an influenza waiver), mandated reporter training certificate and that they may not be left alone with children, as they do not have Child Development units but can work as an Aide with a qualified teacher as long as they do not have any more then 15 children at one time. During this visit a civil penalty was also assessed. All adults 18 and over responsible for administration or direct supervision of staff, or persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or page 1 of 2 exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. The following deficiency listed on the attached LIC 809-D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health & safety. One (1) Type A - A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. Licensee/Director was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form during this visit. A notice of site visit was given and must remain posted for 30 days. This requirement is not met as evidenced by: Based on staff was not a volunteer and did not have fingerprints on file. This poses an immediate Health and Safety risk to children in care.
