What the inspector wrote

On March 28, 2025, at 9:30 am Licensing Program Analyst (LPA) Carolyn Tuba was conducting a complaint investigation and during the course of the visit found that the facility was in violation so a Case Management deficiency was completed. Covid Risk assessment was conducted. LPA met with staff member, Arianna Gomez. During the visit Director, Maria Flores was not present but staff member, Arely Gomez who is a qualified teacher facilitated the visit as the Designated Authorized Individual when the Director is not present. LPA obtained the census of 9 children with 1 staff and a volunteer. LPA observed that some children did not appear to be of preschool age and asked Child #1 (C1), #2 (C2) and #3 (C3) how old they were and what grade they were in. C1, C2 & C3 also stated that they are typically in the school-age program. LPA confirmed with staff member, Arely Gomez who stated that those children are enrolled in the school-age program, but since they are on spring break the staff were instructed by the Director that they could be with preschool age children. Staff member was under the impression that since the preschool license reads 2 years old until entry into first grade, that they were within the limits of the license, however LPA consulted with staff member, Arely Gomez that when children are enrolled in one program they cannot commingle with another program. During the course of the visit LPA observed an additional qualified staff member who arrived at approximately 10:30 am brought the 3 children into the licensed school-age program. In reviewing records of previous inspections visits at this facility, Type-A citations were given on 5/3/2024 and on 3/18/2024 and were issued in accordance and identified as California Code of Regulations Title 22, 101161(a). The same citation is being issued during today’s visit due to disclosures made by C1, C2, C3, page 1 of 2 LPA observation and confirming with the staff members present. Based on children disclosure and staff interview. The following deficiency listed on the attached LIC 809-D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiency that are being cited need to be cleared to protect the children’s health & safety. A civil penalty is also being issued due to repeat violation on 5/3/2024, which is less then a year from today’s visit. LPA, Carolyn Tuba informed staff member, Arely Gomez that this report dated 3/28/2025 document(s) (1) Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety or personal rights of a children in care. Also, LPA, Carolyn Tuba informed the staff member, to provide a copy of this licensing report dated 3/28/2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or written statement, must be placed in the child’s file for verification. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Staff Member, Arely Gomez. page 2 of 2

This requirement is not met as evidenced by: Based on disclosures made by children, LPA observation and staff confirmation that there were 3 school-age children who were being commingled with the preschool children that are from another licensed program. This poses/posed an immediate Health and Safety risk to children in care.
