What the inspector wrote

On July 3, 2025, Licensing Program Analyst (LPA) Monique Ayala conducted an unannounced Case Management visit to the facility for the purpose of delivering enhanced civil penalties pertaining to a complaint received on 01/30/2025. A COVID-19 risk assessment was conducted upon entering the facility. LPA met with Assistant Director, Anqui Zhang and explained the purpose of the visit. There are currently 82 children enrolled. 72 Children and 14 Staff were present in 5 different classrooms during today's visit. The complaint received on 01/30/2025 was regarding an allegation that Staff dislocated a day care child’s arm. The investigation was conducted by the Department’s Investigation Bureau (IB) by Investigator Olivia Spindola. During the investigation, the department conducted interviews with the Reporting Party (RP), Staff #1 (S1) to Staff #6 (S6), reviewed video footage of the incident and reviewed medical records. Medical records indicate that Child #1 (C1) received medical care at Kaiser Permanent Urgent Care (KPUC). The investigation revealed that on 01/24/2025, C1 sustained a left elbow dislocation. The incident occurred when Staff #3 (S3) , who was walking C1 by the left wrist, dislocated the elbow when child fell to their knees but S3 did not release their grip. KPUC diagnosed C1 with a dislocated left elbow. Video footage of the incident and statements provided by S3 and facility staff supports how C1 sustained the left elbow injury. Facility was cited on 5/6/2025 under a personal rights violation. Additionally, a similar incident involving S3 occurred on 08/19/2024 when C1 sustained a right elbow injury after S3 held onto C1’s right wrist when C1 lost their footing. Both incidents involved the same staff, the same child and both injuries requiring medical attention. Enhanced civil penalties are being cited on the attached LIC421D page. An exit interview was conducted and a copy of this report and appeal rights was provided to Assistant Director, Anqui Zhang. A Notice of Site Visit was also provided, Notice of Site Visit must be posted for 30 days.
