What the inspector wrote

On 05/15/26 at 12:35pm, Licensing Program Analyst (LPA) Diana Ortiz conducted an unannounced Case M anagement-Incident Report visit. Per staff members, Director Teresa Fuentes was out for the day and Assistant Director, Nicole Bennett was out to lunch. At approximately 12:50pm LPA met with Assistant Director Nicole Bennett who then guided LPA on a tour of the facility. LPA observed 78 children and eight (8) staff present during this visit. The department received an unusual incident report on 05/04/2026 via telephone call for an incident that occurred on 05/04/26. Written report was received on 05/06/2026. Per Title 22 Regulations the report was reported in a timely manner. During today’s visit, LPA conducted interviews with Assistant Director, and two (2) staff members. LPA reviewed three (3) staff files, and one (1) children’s file. LPA toured the facility. LPA observed the classroom where the incident occurred. Assistant Director explained that the incident occurred in the morning during AM sna ck. Staff #1-Staff #3 stated that during breakfast/snack time, Child #1 was observed with saliva/white foam coming from her mouth and appeared to be having a seizure. All staff stated that Staff #2 laid Child #1 on her side while the remaining children were escorted out of the classroom and 911 was contacted. Staff #1 stated emergency dispatch provided instructions over the phone until paramedics arrived approximately 7–10 minutes after. Staff #1 stated Child #1’s parents were notified immediately after medical was contacted. Staff #1-Staff #3 confirmed they are CPR certified. Staff reported Child #1 returned to care the following day and remains enrolled in the facility. After interviews, observation of the areas and documentation of the incident, it was determined that staff were unable to prevent the incident from happening; therefore, there is no preponderance of evidence to determine that a regulatory violation occurred, the incident was determined to be an accident. Page 1 of 2 No deficiencies or civil penalties are being cited at this time. A notice of site visit was provided, and appeal rights were provided and discussed.
