What the inspector wrote

On 10/21/25, Licensing Program Analysts (LPAs) Diana Ortiz and Roxanna Lopez, conducted an unannounced Case Management-Incident Report visit. LPAs met with Director Erick Morales who guided LPAs on a tour of the facility. LPA observed 14 children and 3 staff present during this visit. The department received an unusual incident report on 10/16/25 via email for an incident that occurred on 10/15/25. Per Title 22 Regulations the report was reported in a timely manner. During today’s visit, LPAs conducted interviews with children, staff, and Director. LPAs observed the outdoor play yard where the incident occurred. LPAs toured the facility and the outside play yard. Director explained the incident occurred at around 11:45am during while the children were outside for playtime. During the time of the incident, there were 12 children and two staff present. S#1 stated the incident happened when the children were outside playing. S#1 stated he observed the children running. S#2 stated she was helping another child with diaper change when the incident occurred. S#1 stated C#1 was heard crying and then C#1 and multiple children ran to S#1 and S#2 and stated C#1 had slipped and fell. S#1 and S#2 said they asked C#1 if she was hurt and C#1 stated she fell but there were no visible injuries. First aide was provided by S#1 and S#2. Per S#1, parent was notified at around 11:50am and mom came within 10-15 minutes. The parent then took C#1 to the ER where she was told she had a sprain on her arm. The child returned to the facility on Monday, 10/20/25. Children’s interviews corroborated that C#1 was running on the grass area and fell on the grass. Page 1 of 2 Parent was provided with an incident report from the facility along with video footage of the incident and LPA obtained a copy of incident report and video footage. After interviews, observation of the areas and documentation of the injury, it was determined that staff were unable to prevent the injury from happening; therefore, there is no preponderance of evidence to determine that a regulatory violation occurred, the incident was determined to be an accident. No deficiencies or civil penalties are being cited at this time. Exit interview conducted and report reviewed with Director , Erick Morales .
