What the inspector wrote

On 1/12/2026 the department received additional information in regards to the original complaint. No contact information was provided by RP to obtain further information. Allegation 1: Personal Rights - Licensee did not ensure that adequate supervision was provided to children in care. On 12/11/2025, and 1/21/2026 LPA Ruiz conducted surveillance of the facility above to evaluate the allegations listed above. On 12/11/25 LPA Ruiz could hear the faint sound of children playing inside the facility noted above. LPA surveyed the facility for 30 minutes and did not hear yelling or crying coming from inside the facility. LPA entered facility and conduct inspection. LPA Ruiz observed children in care playing in the backyard with S1. The children playing were laughing and talking to each other and communicating appropriately for their ages and activities. LPA interviewed Licensee regarding the allegations listed above. Licensee states that last year one child enrolled took a long time adjusting to being in day care and would cry in the morning after drop-off. Licensee states that they had a discussion with C1's mother regarding C1 not acclimating to the day care and that C1\342\200\231s mother eventually removed child from day care. LPA interviewed S1 regarding the allegations listed above. S1 states that the day care children do not cry excessively and that if they are misbehaving, they use redirection to discussion to resolve the issue. S1 states that they and Licensee trade off caring for the children in doors and outdoors, so that children can have different types of activities during the day. Over the course of this investigation, LPA reviewed and/or obtained copies of the children\342\200\231s roster, children\342\200\231s files, staff files, Parent Handbook, photos, and interviewed licensee, S1, children, parents, and neighbors. page 2 LPA left messages for Parents 1 and 3 but did not receive a return call. Parent 2 stated that they and their children are very happy with the care provided and do not have concerns about the care provided. Parent 2 also states that children have never complained about their day care provider and state they like attending day care. LPA Ruiz left business cards and sent contact letters to surrounding neighbors. On 1/21/2026, LPA surveyed the facility before entering. LPA Ruiz could heard a child in care playing near the front door. LPA heard a child crying, then heard Licensee approach child and comfort them, child immediately stopped crying and spoke in a normal tone to licensee. LPA Ruiz interviewed children in care and no disclosures were made. Children interviewed state they like their day care. LPA Ruiz received a return phone call from a neighbor (W1). W1 states they have lived at their address for several years and have witnessed the licensee interacting with children and have no concerns with the way Licensee or S1 cares for the day care children. W1 states they also work with children in their career and have heard the children crying occasionally but not excessively. W1 states they are home during the day and can hear the children playing in the backyard with S1 and sometimes the children in care argue with each other and S1 will step in to try to resolve the problem and licensee will redirect children, but they have not heard Licensee or S1 yelling at the day care children. W1 added that Licensee and S1 seem like they are both good people and that they are friendly to neighbors. Based on interviews conducted and records reviewed, the preponderance of evidence has not been met, therefore the above allegations are found to be UNSUBSTANTIATED. page 3 of 3
