What the inspector wrote

Pre-Licensing Family Child Care home Inspection Conducted In English Licensing Program Analysts (LPA) Cynthia Reyes conducted an announced Pre-Licensing inspection on this date for the purpose of inspecting the facility to ensure the health and safety standards as required by the regulations governing childcare homes are met for initial licensure. A copy of the Pre-licensing Entrance Checklist for Child Care homes form (LIC 9280) was provided. LPA met with applicant Susan who confirmed the family members residing in the home, that consists of 5 adults and 7 children. (2 adults and 3 children live in the back house which is the same address and are the applicants land lord) Present during this inspection was Applicant, her husband and her mom. Applicant is requesting a small (8 Capacity) family child-care home license . Per Applicant, operating hours will be Monday to Friday, 7:30AM to 5:00PM. At 9 AM applicant Susan guided the LPA on a tour of the facility, indoors and out. All areas identified on the facility sketch were inspected, including but not limited to, off limit areas. The home was inspected for safety, comfort, cleanness, telephone service, heating and ventilation, inaccessibility to poisons, detergents, cleaning compounds, medicines, and hazardous items that can pose a danger to children. The applicant states that she will provide food for children in care. Licensing staff advised that if children bring food from home, it should be properly labeled. Page 2 Per applicant there are no weapons or firearms currently in the facility. The backyard is adequately fenced (Brick wall) and there is an in-ground swimming pool, which was observed on the premises. The pool is in the back yard and can be accessed from the family room of the house, which is accessible to the children. The family room has a sliding door and two sliding windows. (Alarms will be placed on all). LPA observed the back yard which is surrounded by cement and some grass areas. The swimming pool has a 5ft mesh gate surrounding it completely. There is a self-latching gate that opens away from the pool. The gate's latch is no more than 6 inches from the top of the gate and has a lock on it. It is constructed to not obscure the pool from view and is strong enough to withstand force against it. Each vertical railing of the gate is no more than 2in apart and the bottom of the gate goes completely down to the cement ground with no openings. (Pool check list completed and placed in applicants file). LPA also observed there are age-appropriate toys indoors and out and age appropriate napping equipment. During the walk threw of the interior of the home LPA observed the smoke detector and carbon monoxide and LPA had the applicant test both and were verified to be in operable condition. LPA also observed the required fire extinguisher (2A 10BC) located in the living room/day care area with a service date of 04/11/2023. The areas observed by the LPA and confirmed by the applicant during the inspection, were the: Off limits areas are : 3 Bedroom, 1 bath room (2nd) in the hallway. laundry room, Back house/Garage, drive way, kitchen and front yard **Rooms that are off-limits need to be made inaccessible during operating hours** The applicant does understand that licensing staff may have access to off-limit areas during the inspection if necessary. Areas used by children are: Living room, family room, 1st bathroom, dining area & back yard. Page 3 Landlord Consent - Family Child Care Homes. The applicant rents the home, proof of landlord notification is required. The LPA observed and obtained a copy of the Landlord Notification form (LIC9151) that the applicant confirms was provided to the property owner/landlord. The LPA also obtained a signed Property Owner/Landlord Consent form (LIC 9149) from the applicant. Without this consent, the applicant understands that, once licensed, they can operate with a maximum capacity of 6 [or 12] children. If property owner/landlord consent is obtained in the future, the applicant is advised that a new Application for a Family Child Care Home License (LIC 279) must be submitted with a change of capacity fee of $25, to increase the capacity and provide care to 8 [or 14] children. Infant Care: LPA discussed the safe sleep regulations with applicant and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep , as an additional resource. LPA also informed applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/ , and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. The applicant has completed the required Health and Safety Training 10/21 & 22/2023, Nutrition Training and Pediatric First Aid and CPR. (Exp. 11/04/2025). LPA observed there are first aid supplies available on the premises. Applicant will wait till the facility opens to determine if will be used. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Page 4 The following was discussed with the applicant: Criminal Record Clearance- Applicant was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. \302\267 In the absence of the licensee a qualified adult must be present supervising the children; a qualified adult is an individual who has a valid and current Pediatric First Aid and CPR training, Immunization (TDAP, MMR, Influenza), mandated reporter training and a valid criminal record clearance associated to the facility license. \302\267 Annual fees must be paid promptly and by the due date or a late fee shall be assessed and/or the License may be terminated. \302\267 The fire extinguisher type 2A-10BC must be serviced annually or as often as necessary. Smoke and carbon monoxide detectors should be checked, and batteries replaced as needed. \302\267 Reporting Requirements: Changes should be reported to the Department as soon as they occur such as construction, remodeling, telephone number changes and/or if you move from your home. \302\267 Reporting Requirements: Any unusual incidents or injuries must be reported to the Department within 24 hours via telephone and within seven (7) days in writing. \302\267 Fire and safety drills must be performed each month and documented for review by the Department. \302\267 Smoking is prohibited in a family childcare homes. Page 5 Continue from last page Children and Staff records must be maintained and updated as needed and must be available for review by the Department. If Children and Staff leave the day care all records must be maintained for 3 years after leaving. \302\267 No infant walkers, no Johnny jumpers, no saucer chairs, no trampolines and any other item that falls into those category\342\200\231s, are not permitted in the facility. \302\267 Inspection Authority: All adults living and working in the home shall be made aware of the Department\342\200\231s right to inspection of the home, which includes, but is not limited to the right to enter the home when children are being cared for, interview children and adults, review documentation and observe off limit areas if needed. \302\267 The facility license number must be on all advertisements, publications or announcements with the intent to attract clients. \302\267 Isolation for Ill children: When a child is ill he/she shall be separated from other children (reference 102417(e) Operation of a Family Child Care Home). \302\267 Liability Insurance was discussed; LPA advised applicant to review Title 22 Regulation 102417(m)(1) for additional information. \302\267 Immunization Requirement: H&S 1597.622: Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis (Tdap), & measles (MMR). The licensee & all adults working with children must have proof of immunizations. \302\267 Mandated Reporter Training: H&S 1596.8662: Beginning January 1, 2018, all licensed providers, applicants, directors and employees are to complete training as specified on mandated reporter duties. Training is available at: www.mandatedreporterca.com Page 6 \302\267 LPA advised the applicant how to access forms, regulations, and quarterly updates on the Child Care Licensing website at: www.ccld.ca.gov LPA reviewed with applicant the LIC 311D, Forms/Records to Keep In Your Family Child Care Homes, children\342\200\231s forms/records, facility forms/records, and information to be posted. Entrance Checklist was provided to the applicant. Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. To receive important licensed related information to licensed facilities, visit the CCLD Important Information website at https://www.cdss.ca.gov/inforesources/community-carelicensing/subscribe and select the Child Care option to receive email communication. Applicant\342\200\231s email address was verified/obtained during this inspection. The applicant was advised that the email may be public information. (Email address here) MyChildCarePlan.org \342\200\223 Applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain childcare by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. On this date, 01/29/2024, the California Attorney General - Megan\342\200\231s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ. Page 7 The applicant\342\200\231s signature on this report acknowledges that they have signed the Application for a Family Child Care Home License (LIC 279) under penalty of perjury that the statements on the application and any attachments are correct. Based on licensing staff observations, the following corrections need to be corrected prior to obtaining a family childcare license. Corrections are due before or by: 02/05/2024 1) Alarms on windows and doors in family room for swimming pool 2) Adult in back house fingerprint cleared. 3) Rose bushed and BBQ removed or barricaded. Once the pending corrections are cleared the home will meet the description of a safe and healthy environment for children as described in Chapter 1, Division 12, Title 22 of California Code of Regulations, and the facility file will be submitted for approval for a Small family childcare license. (Capacity 8). Once licensed, the applicant is required to adhere to the terms and limitations stated on the license. A notice of site visit was given to applicant and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Exit interview conducted and report was reviewed with the applicant Susan.
