What the inspector wrote

On 04/24/25 Licensing Program Analysts (LPAs) Mary Silva and Diana Ortiz conducted an unannounced annual random inspection at the above facility. Licensing staff met with Licensee Sara Lopez, to whom the reason for the inspection was explained. LPAs were guided on a tour of the facility. There were four children present including one infant. Facility capacity is in compliance for a small Family Child Care Home. Per licensee four children are currently enrolled. Hours of operation are Monday-Friday 7:00 AM - 6:00 PM. The Entrance Checklist LIC 126, was provided to the Licensee during this visit. This is a one story home which consists of 3 bedrooms,1 bathroom, kitchen, dining room, family room/daycare room, formal living located to the left of the entry way, an inoperable electric fireplace was observed in the formal living room made inaccessible to children in care, front yard, fenced backyard, in ground swimming pool and detached garage. There was a total of 2 adults during this inspection, licensee and licensee\342\200\231s spouse. Areas used by children are: Entry hallway, kitchen, dining area, family room, formal living room, one bathroom, one bedroom used for napping, sleeping cots were observed & fenced back yard. Off limits areas are : Two bedrooms, front yard, garage and in ground swimming pool. Reminded applicant, rooms that are off-limits need to be made inaccessible during operating hours. The applicant does understand that licensing staff may have access to off-limit areas during the inspection if necessary. Page 1 of 4 LPA observed the following required posted documentation in the main entry way of the facility: Facility License, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form. LPA reviewed facility records for LIC 9040- Facility Roster, LIC 610- Facility Disaster Plan. Per licensee a disaster drill has not been conducted with children. The home was observed to be clean and orderly, with central air and heating. Licensing staff observed the smoke detector and the carbon monoxide detector to be in operable condition. Licensing staff observed the valve on the required 2A 10BC fire extinguisher indicates fully charged purchased on 02/28/2024. Reminded licensee fire extinguisher should be serviced yearly. The home maintains telephone service via cell phone. There are toys and other age-appropriate material available for children. Licensee prepares breakfast, lunch, and pm snack for the children in care. Licensee transports children before and afterschool. LPAs observed a first aid kit in the entrance and in the bathroom. Licensee states that there are no poisons stored in the home and understands that all poisons must be locked, to be made inaccessible to children. Per Licensee there are no firearms or weapons stored in the home. Licensing staff reminded licensee smoking is not allowed in the home. The Licensee uses the right side of the back yard for outdoor play. The outdoor play areas were observed to be fenced. Licensing staff observed that the outdoor yards have toys and other materials for children to play with, including a small trampoline, reminded licensee children must be under supervision at all times when using equipment. LPAs observed a bag of charcoal on the far-left side of the yard next to the play area, and dog feces on a dustpan. Licensee removed items during this visit. Licensee has two dogs: a medium size Golden Retriever and Chihuahua kept in the garage when children are outdoors, and two cats that remain in one of the bedrooms. Reminded licensee pets must remain inaccessible during hours of operation. LPAs observed an in-ground swimming pool in the back yard with a self- latching gate which opens away from the swimming pool and a lock that requires a key to the access the pool. The swimming pool has tempered glass framed fencing which is 5ft tall. The measurement from the hard concrete surface to the bottom of the fence is 2 1/2 inch. LPAs observed a life ring with diameter of 20 inches, and a 12 ft rescue pole with a body hook. Per licensee a pool alarm has not been purchased and a daily safety log has not been maintained. Page 2 of 4 Child\342\200\231s records were reviewed for (LIC) 282- Affidavit Regarding Liability Insurance, Immunization's Records, LIC 700- Identification and Emergency Information, LIC 627- Consent for Medical Treatment, and LIC 995A Notification of Parents\342\200\231 Rights. Based on record review child # 1 and child #2 did not have immunization records on file, child #3 and child #4 had incomplete files with immunization records only. Licensee file was reviewed for the following: LIC 508- Criminal Record Statement, Proof of immunizations against measles, pertussis and influenza or influenza declination, TB clearance or risk assessment, LIC 9108- Statement Acknowledging Requirement to Report Child Abuse. Pediatric First Aid and CPR certification on expires 01/06/2026 for licensee. Mandated Reporter Training has been completed and expires on 05/07/2026 for licensee. www.mandatedreporterca.com LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. Licensee currently has one infant enrolled and will turn two years old within a week from today\342\200\231s date. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Page 3 of 4 Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. MyChildCarePlan.org \342\200\223 Centers and Family Child Care Homes - Licensee, was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California. Megan\342\200\231s Law - Family Child Care Homes - During the exit interview, Licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. Based on Licensing staff observations and records review, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children\342\200\231s health and safety. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal rights was given. Exit interview was conducted and report was reviewed with licensee Sara Lopez.
