What the inspector wrote

Licensing Program Analysts (LPAs) Jeanette Estrada and Tyler Reyes conducted an unannounced case management inspection at the facility due to an incident that was reported to the Department. LPAs met with facility representative and explained the reason of the visit. LPA observed 32 children supervised by 12 staff during the inspection. The unusual incident was reported on 9/20/24 and it involved a violation of a child\342\200\231s personal rights. It was reported that a picture of Child 1 using the restroom in the classroom was found on a cell phone that belonged to the facility. Per interviews conducted by Community Care Licensing\342\200\231s Investigations Branch (IB) investigator, Christine Ferris, Staff 1 admitted to taking a picture of Child 1 using the restroom to show Child 1\342\200\231s parent. The picture was found by Staff 3 on 9/19/24 on the classroom\342\200\231s cell phone used to share pictures with parents. Staff 3 was looking for a picture of another student when they stumbled across the picture of Child 1 and immediately reported it to Ana Narquardt, Associate Director of Education for St. Anne\342\200\231s. Surveillance cameras were reviewed for the date in which the picture was taken (approximately two weeks prior) which revealed Staff 1 and Staff 2 in the classroom at the time. Per Staff 1, they did not have malicious intent when taking the picture. They simply wanted to share with the parent that Child 1 used the restroom that day. Per Staff 1, the day got busy and they forgot they took the picture and never shared it with the parent. According to Ana Narquardt, the company\342\200\231s Information Technology Department (IT) confirmed that the picture was not sent to any other device. Although Staff 1 did not have malicious intent when taking the picture of Child 1, Staff 1 violated Child 1\342\200\231s personal rights by taking the picture of Child 1 using the restroom, an activity which should be treated with care. A type B deficiency is being issued today for personal rights 101223 (a)(1) . Exit interview conducted with Facility Representatives. A copy of this report and a Notice of Site Visit were provided. Facility Representatives were advised Notice of Site Visit must remain posted for 30 days.

This poses a potential risk to the personal rights of chidlren in care.
