What the inspector wrote

On 2/20/26 Licensing Program Analyst (LPA) Alicia Mooberry conducted a a follow up case management visit to the facility regarding an incident reporting a personal rights violation. The incident occurred on 1/20/26 and reported to the department on 1/26/26. LPA met with Vivian Castaneda, Site Supervisor, who allowed entry into the facility. LPA informed of the reason for inspection and was provided a tour of the facility. LPA observed 23 children supervised by 9 staff in classrooms 1-6. The facility reported that on 2/20/26 Staff #1 (S1) was observed to pull child #1's (C1) hair backyards and also tapped Child #2 (C2) on the hand. Interviews conducted revealed the following: On 1/20/26 while in outdoor play area. S2 observed C1 attempting to bite Child 3 (C3), S1 pulled C1 by the hair causing C1's head to jerk backwards. Later on the same day, S2 reported that C3 and C4 were playing together and began to fight over a stroller, S1 took the stroller away and tapped C3 child's hand. Surveillance cameras are present, but the footage was not available for LPA to review. Per interview with Site Supervisor and HR representative S1 was relieved of duties and is no longer employed by the facility as of 1/28/26. LPA did not observe S1 present during inspection. Based on interviews conducted, C1 and C3's personal rights were violated which posed an immediate risk to the health and safety of children in care. Based on interviews and record review the incident was not reported to the department within the required 24 hours of occurrence which poses a potential risk to the health and safety of children in care. 1 A deficiency and 1 B deficiency are cited on this date in accordance with Title 22 regulations.--Pg 1of 2 Per Site Supervisor, the facility has taken steps to ensure the staff have training on ways to manage challenging behavior as well as reporting requirements. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child\342\200\231s file immediately upon receipt from parent. The Site Supervisor was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form LIC9224 during this visit. The Notice of Site Visit (LIC 9213) \342\200\223 must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Notice of Site Visit was provided and needs to be posted for 10 Days. Exit interview was conducted with Vivian Castaneda, Site Supervisor. Appeal Rights were discussed and provided.

This poses an immediate risk to the health and safety of children in care.
