What the inspector wrote

On October 7, 2025, at 9:35 AM, Licensing Program Analyst (LPA) A. Carter conducted an Unannounced Annual / Random inspection and met with Facility Representative (FR) Esmeralda Hernandez, licensee\342\200\231s assistant . LPA disclosed the purpose of the inspection and was granted entry into the facility. Licensee was not home at time of inspection. LPA provided assistant with a copy of the Facility Entrance Checklist. All adults associated to the home were found to have criminal record clearance. There were (3) daycare children present at the start of today\342\200\231s inspection. FR states there are currently (24) children enrolled. LPA reviewed facility roster to confirm. The facility\342\200\231s hours of operation are Monday through Sunday from 5:00 AM to 2:00 AM. Facility provides transportation. \302\267 At 9:55 AM, licensee\342\200\231s husband arrived \302\267 At 10:07 AM, second assistant arrived \302\267 At 10:20 AM, child#4 arrived This is a two story home which consists of (8) bedrooms, (5) bathrooms, and detached garage. The living room and two bedrooms were converted into the day care area. The children have access to the bathroom inside the day care area. Areas off limits to children include: The family room, one bedroom and bathroom, and kitchen on the first floor, the entire second floor with five bedrooms and two bathroom are off-limits to children in care. The dining room, kitchen and family room are on limits in passing to the backyard. There is also one bathroom in this section of the home that is accessible for emergencies. LPA observed a safety gate separating the main day care area and the rest of the home. The upstairs is made inaccessible by a safety gate located at the bottom of the stairs. The licensee does understand that licensing staff may have access to off-limit areas during inspection visit if necessary. Report Continues Page 1 of 5 Page 2 of 5 LPA observed a baby gate separating areas used by children and off-limits area and safety knobs on doors making them inaccessible to children in care. All areas identified on the facility sketch as accessible to children were inspected to ensure that they are clean and orderly with ventilation and heating for the safety and comfort of the children. LPA observed required posted documentation in the main care living room which included: Facility License, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form. LPA observed LIC 610- Facility Disaster Plan and Disaster drill log, last drill conducted on 09/26/25. Dual smoke/carbon monoxide detectors observed at facility at the time of inspection. LPA observed the 2AB10BC fire extinguisher with receipt date of 09/22/25. The facility has central air, and LPA observed a ceiling fan in the main care area. The facility maintains telephone service via cell phone. LPA observed age appropriate toys and learning materials available for children in care, free of loose and sharp parts. At 10:00 AM, LPA observed cubbies for children\342\200\231s belongings, books, learning charts, and dramatic play toys. One room is used as an office / activity space. LPA observed a small rug and plush toys. The second room is used as a napping room. LPA observed 3 play yards against the wall. Napping equipment did not block the entrance or exit. LPA did not observe any objects inside or hanging on/or around play yard. There is a screened fireplace in the off-limits dining room, inaccessible to children in care. The children use the bathroom inside main care area. LPA did not observe any hazards in the bathroom and observed a safety latch on the cabinet under the sink. Detergents, cleaning compounds, and medications are stored in an off-limits area of the home inaccessible to children in care. Facility representative states there are no poisons in the home and understands that poison must be locked. The isolation area for sick children waiting to be picked is the office, supervised away from the other children in care. Food is provided for children in care. LPA reminded FR that any food brought from the children\342\200\231s homes shall be labeled with child\342\200\231s name and properly stored or refrigerated. The children have access to the backyard for outdoor play. At 10:15 AM, LPA observed age appropriate toys available for children in care. The play area is covered, providing ample shading for children in care. LPA observed a jacuzzi in the backyard. Page 3 of 5 The jacuzzi has a cover on it that withstands the weight of an adult. The cover is locked on four sides. The step stool has been removed and placed in the locked garage. FR Hernandez states, children are supervised while playing outside. LPA observed yard has grass and adequate perimeter fencing through-out the property. Play area is free of loose and sharp articles or objects and all trees, shrubs, and plants are maintained. LPA observed 5 dogs in the enclosed dog run on the side of the home. Infant Care: Currently there are 2 infants enrolled. FR Hernandez was advised, infants shall not be swaddled in care. Car seats shall only be used for transportation purposes and shall not be used for sleeping. LPA discussed Safe sleep regulation, including LIC 9227 Infant Sleep Plan for infants under 12 months, 15-minute sleep check documentation for infants 0 \342\200\223 24 months. Overnight Care : LPA discussed the following: Staff must remain awake while children are awake. If children sleep in a separate area from staff, the door must remain open. If staff cannot hear children when they wake up, video or audio device can be used. Children\342\200\231s records were reviewed for (LIC) 282- Affidavit Regarding Liability Insurance, Immunization's Records, LIC 700- Identification and Emergency Information, LIC 627- Consent for Medical Treatment, LIC 995A Notification of Parents\342\200\231 Rights, and documentation of 15-minute Infant Sleep Check (0-24 months). All required licensing forms are in file. Staff records were reviewed for approved Pediatric First Aid and CPR certification,LIC 508-Criminal Record Statement, LIC 9052- Employee Rights, Proof of immunizations against measles, pertussis and influenza or influenza declination, TB clearance or risk assessment, LIC 9108- Statement Acknowledging Requirement to Report Child Abuse and current Mandated Reporter Training Certificate. \342\200\224Pediatric CPR / First aid Card valid until: 06/12/27 \342\200\224Mandated Reporter AB1207 Completed: 06/26/27 Per FR Hernandez, there are no children enrolled that need medication administer, or any children with allergies in care at this time, there are no smokers, or weapons, or firearms in the home at time of inspection. LPA observed 5 pet dogs on the side of the home, and jacuzzi covered and locked in the backyard at time of inspection. Page 4 of 5 During the inspection, children present were observed to be treated with dignity and respect, observed to be receiving safe, healthful, and comfortable accommodations, furnishings, and equipment, and free from corporal and/or unusual punishment. The following were discussed: Rooms that are off-limits need to be made inaccessible during operating hours. NO smoking, NO infant walkers, NO Johnny jumpers, NO saucer chairs, NO incline sleepers and any other item that falls into that category are permitted in the facility. Effective January 1, 2010, licensees of family child care homes are required to ensure that at least one staff member with current training in Pediatric CPR / First Aid is on site at all times when children are present. The fire extinguisher type 2A10BC must be serviced annually or as often as necessary. Smoke and carbon monoxide detectors should be checked, and batteries replaced as needed. Reporting Requirements: Changes should be reported to the Department as soon as they occur such as construction, remodeling, telephone number changes and/or if you move from your home. Any unusual incidents or injuries must be reported to the Department within 24 hours via telephone and within seven (7) days in writing. Facility representative was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Page 5 of 5 LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. During the exit interview, the facility representative Esmeralda Hernandez, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. There are no deficiencies cited today in accordance with California Title 22 Regulations. A notice of site visit was given and must remain posted for 30 days.
