What the inspector wrote

On 11/8/25, Licensing Program Analysts (LPA) Tyler Reyes conducted an announced Pre-licensing inspection and met with Applicant Guerrero, Noe. LPA disclosed the purpose of the inspection and was granted entry into the facility by the applicant. Per applicant hours of operation are Monday through Sunday from 6am-6am. LPA discussed with Applicant that \342\200\234Overnight Care\342\200\235 means care being provided to children anytime between the hours of 6pm and 6am. Care provided during the day and overnight combined shall not exceed 24 hours from the time the child entered care . The applicant has applied to serve 0-13 years. LPA discussed and provided copies of Capacity Regulations for Family Child Care Home License, Personnel Report LIC 500, and Child Care Facility Roster LIC 9040. During the inspection, the following individuals were present in the home: Applicant Noe. All individuals residing in the home have been discussed and noted. All adults present in the home have obtained a criminal record clearance or exemption. The applicant acknowledges and understands that any individual residing in the home who is 18 years of age or older must undergo criminal record clearance and be associated to the facility, or they will be subject to civil penalties pursuant to Title 22 regulations. Facility Postings: LPA observed the required postings in the entrance: PUB 394 Notification of Parents\342\200\231 Rights, LIC 9148 Earthquake Preparedness, and LIC 610A Emergency Disaster Plan. LPA discussed the documents to be posted in a prominent, publicly accessible area at facility. On- Limits: Front yard, living room, kitchen, (1) restroom (3) bedrooms, and backyard. Off Limits: (1) restroom, (2) bedrooms, and garage. Applicant was informed that any future changes to the facility sketch must be updated and submitted to the department. Page 1 of 5 Pediatric CPR/First Aid in Pediatrics Certification: Applicant Noe Completed American Heart Association Issue 5/25/2024 and Renew by 05/2026 Emergency Disaster Drill: LPA discussed that that once licensed, the licensee shall conduct fire and disaster drills at least once every six months and must document each drill, including the date and time it was conducted. Documentation of fire and disaster drills must be kept ready for review. Infants: LPA discussed infant safe sleep with Applicant Noe. LPA observed (2) cribs in the on-limit bedroom. LPA observed a fitted mattress and fitted sheet. All cribs or play yards shall meet the United States Consumer Product Safety Commission. Mattresses shall be firm and covered with a fitted sheet that is appropriate to the mattress size, fits tightly on the mattress, and overlaps the underside of the mattress so it cannot be dislodged. Cribs or play yards shall be free from all loose articles and objects. Facility should supervise infants while they are sleeping adhering to physical checks every (15-minute) and ensuring infants are sleeping on their back. Documentation of these checks shall be maintained in the infant\342\200\231s file and made available for Department review. Documentation shall include the date, infant\342\200\231s name, and the time of each (15-minute) check. The infant\342\200\231s authorized representative and emergency contact shall be notified if any signs of distress or labored breathing are observed. LPA informed Applicant pacifiers shall be allowed in crib or play yard if the following: There shall not be anything attached to the pacifier and pacifier shall be specific to the infant. An individual Sleep Plan LIC 9227 shall be completed for each infant up to12 months of age. LPA provided the Licensee with copies of the Infant Safe Sleep information from California -DSS-Manual -CCL Items not permitted: LPA provided the Applicant with a picture listing some of the items not permitted in a family childcare home, which include a bouncer, a jumper, and a walker. These items are not allowed to be on the premises of the facility. Meals: Per applicant, children will have meals in the daycare room. Applicants will provide meals for children. The applicant was advised to ensure all food brought from home is properly labeled and stored. Medication: Per Licensee the facility will provide incidental medical services if required. Medication will be inaccessible to children by centrally storing and locking. Medications will be administered in accordance with PIN 22-02-CCP, which outlines requirements for proper storage, documentation, and staff training. Page 2 of 5 The following on-limit areas that will be used by children were inspected for safety, comfort, and cleanliness. Telephone service is provided via cell phone. Heating and cooling are provided by portable air conditioners. LPA observed in the on-limit living room an unscreened wall heater. LPA informed Applicant open face heaters shall be screened to prevent access by children. LPA observed a 2A10BC fire extinguisher located the kitchen with a service tag 8/19/25. Family Child Care Homes are required to maintain a new or serviced fully charged fire extinguisher which is at least a2A:10BC annually. LPAs observed electrical outlets with covers. LPA reminded the licensee to ensure that unused electrical outlets always remain covered. The isolation area for sick children is a separate area of the daycare room. LPA observed an operable smoke and carbon monoxide detector. LPA did not observe accessible sharps. LPA reminded Licensee to ensure all sharps are stored in a manner both inaccessible and age appropriate for children. LPA provided Applicant Noe with information on how to access Family Child Care Homes Handbook Manuel of Polices and Procedures on California Department of Social Services website. Poisons/Cleaning Products: LPA informed Applicant to ensure that all poisons are kept key locked and remain inaccessible to children in care. LPA observed no personal hygiene products accessible in on-limit restroom. LPA reminded Licensee to ensure all child safety latches are age-appropriate for children in care. Outdoor: Children may use font and backyard for outdoor play. The facility backyard is enclosed. Per Applicant Noe children will be supervised during outdoor play. No animal feces were observed. There are no pools or spas, or other bodies of water. Applicant was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. The applicant provided proof of control of property. Page 3 of 5 Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA reviewed with applicant the LIC 311D, Forms/Records to Keep In Your Family Child Care Homes, children\342\200\231s forms/records, facility forms/records, and information to be posted. Entrance Checklist was provided to the applicant. LPA discussed the safe sleep regulations with applicant and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep , as an additional resource. LPA also informed applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/ , and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. On this date, 11/18/2025, the California Attorney General - Megan\342\200\231s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ. Applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs)throughout California. Page 4 of 5 Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. To receive important licensed related information to licensed facilities, visit the CCLD Important Information website at https://www.cdss.ca.gov/inforesources/community-care-licensing/subscribe and select the Child Care option to receive email communication. Based on the LPA observation, the following corrections need to be completed prior to obtaining a small family childcare license. Proof of the correction must be sent to LPA by 12/1/25 \302\267 Wall Heater on-limit living room: Open face heaters shall be screened to prevent access by children. A small Family Child Care Home license will be granted upon review by a Licensing Program Manager. Once licensed, the applicant is required to comply with the terms and limitations stated on the license. Applicant was advised that approval of the application will be determined by the Department once all corrections are received.
