What the inspector wrote

On 01/19/2023, Licensing Program Analyst (LPA ) Jeovanna Yanez conducted an unannounced case management inspection. LPA met with Director, Aimee Orcutt, for the purpose of conducting a case management inspection regarding a violation of Health and Safety Code Section 1597.16(a)(1) in accordance with Assembly Bill (AB) 2370. Lead is a toxic metal that can be harmful and unhealthy for humans. Lead is odorless, colorless, and tasteless. Water lead testing was implemented to ensure there is safe water for consumption at Child Care Centers. Assembly Bill 2370, Chapter 676, Statutes of 2018 requires all Child Care Centers (CCCs) that are located in buildings constructed before January 1, 2010, have their drinking water tested for lead and post the results by January 1, 2023 and every 5 years after the date of the initial test. As of this date, the facility has not provided Community Care Licensing (CCL) with evidence of lead testing being completed on water used for drinking or food preparation as required, therefore the facility is out of compliance. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiency is being cited: (see next page, 809-D). Licensee was provided a copy of their appeal rights. Exit interview conducted and report was reviewed with facility representative, Aimee Orcutt. This report shall be made available to the public upon request. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

This requirement was not met at evidenced by: Based on interview, the facility has not completed lead testing on water used for drinking or food preparation as required, which poses a potential health, safety or personal rights risk to persons in care.
