What the inspector wrote

Based on the information obtained during the investigation, the allegation that licensee provided care for a child in an off limit area was corroborated. The preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiency is being cited: (see next page, LIC 809 D). Licensee Manuela Garcia was provided a copy of appeal rights. LIC 9213 Notice of Site visit form was provided to Licensee Manuela Garcia and is required to be posted for 30 days. This report shall be made available to the public upon request.

    Personal Rights: Each child receiving services from a family childcare home shall have certain rights ...........(4) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, ..........This requirement was not met as evidenced by: Based on interviews and Licensee Garcia’s own admission, LPA Herrera obtained information that children were put in highchairs for a brief period of time as a form of discipline. This poses a potential risk to the health and safety of children in care.

  • ALTERATIONS TO EXISTING BUILDING OR GROUNDS

    (a) Prior to making alterations or additions to a family child care home or grounds, the licensee shall notify the Department of the proposed changed, including, but not limited to, the following: (6) Any change from an area of the family child care home previously identified as "off limits" to an area where care and supervision will be provided to children in care.This requirement is not met as evidenced by: Based on interviews and Licensee's own admission that she had permited children to use the home's second floor. Furthermore, Interviews corraborated the allegation as children provided accurate discriptions of the home's second floor, which poses a potential health, safety or personal rights risk to persons in care.
