Inspector’s narrative

What the inspector wrote

On 9/27/2024, at approximately 2:00PM, Licensing Program Analyst (LPA) Jonathan Tse conducted an unannounced annual visit at the facility. LPA met with Teacher Aisha Surty (S1) and explained the purpose of the visit. Present during the visit was S1, two staff members, and seven preschool age children. The facility is operating within staffing and ratio requirements on this day. Director Catherine Hills (D1) arrived at 3:35PM. The facility\342\200\231s operating hours are from 8:00AM to 5:30PM. LPA and S1 inspected the facility for any health or safety hazards. LPA observed there to be fully charged fire extinguishers present that are at least size 2A10BC. LPA observed a fire alarm system to be running throughout the facility. There is a carbon monoxide detector present. Electrical outlets are covered or blocked when not in use to be inaccessible. Poisons, cleaning detergents, and other chemicals are stored inaccessible to children in care. Off-limits areas are inaccessible with the use of childproof gates and locks. LPA observed there to be age-appropriate toys and learning materials present. Furniture is age-appropriate and free of rough or sharp edges. Children nap on mats that are provided by the facility. Children bring bedding from home and take it back once a week for cleaning. The facility cleans mats once a week or as needed. Children bring all snacks and lunches from home. The facility has snacks available in case children do not bring food from home. Water bottles are brought from home and refilled from a non-contaminating fixture. The outdoor play area was observed to be free of debris or other loose articles. It is enclosed by a fence that is at least four feet high. There are age-appropriate toys and equipment available for children to use. Play structures are cushioned with resilient padding. There is shade available from umbrellas and trees. Drinking water is brought outside so that children have access during outside play. There are no swimming pools or similar bodies of water present in the facility. Continued on Page Two Page Two LPA reviewed five staff files, five children\342\200\231s files, and facility records. There is at least one staff member present with Pediatric First Aid/CPR training. All staff have completed Mandated Reporter Training. LPA advised that children\342\200\231s files shall include Emergency Identification and Information (LIC700), Consent for Emergency Medical Treatment (LIC627), Preadmission Health History (LIC702), and a copy of the admission agreement. LPA discussed the requirement to maintain all children\342\200\231s records in the facility with D1. See LIC809-D for deficiency cited today regarding children\342\200\231s records. LPA discussed the requirement for personnel records, if maintained in a central administrative location, to be readily available for review by the Department. The facility tested its fixtures for lead after the deadline of 1/1/2023. No exceedances of lead were found in any of the tested fixtures. LPA informed D1 that a deficiency would be cited and cleared for not testing before the deadline of 1/1/2023. The facility is in compliance with lead testing requirements as of 9/27/2024. LPA advised that lead testing shall be conducted every five years. To improve the quality and value of the new inspection process, a survey may be sent to the email address provided. Facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Continued on Page Three Page Three Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department.
