What the inspector wrote

On 10/18/2024, Licensing Program Analysts (LPAs) Leong and Gil conducted a scheduled pre-licensing visit with the Applicant, Dalia Chan Rosado. The applicant requested a visit from the department because she applied for a large Family Child Care Home (FCCH) license and moved from another Family Child Care Home location. Before this visit, the applicant was previously licensed under license # 214005551. Two cats were present, and according to the applicant, both cats are vaccinated, The applicant lives with her two adult children. She rents the apartment unit and intends to operate from 6:00 a.m. to 6:00 p.m., Monday through Friday. LPAs informed the applicant that she must notify her parents or guardians using the LIC 282 form in the absence of childcare insurance. The applicant plans to care for children from three months old to thirteen years of age, and the children\342\200\231s parents or guardians are required to provide breakfast, lunch, and snacks for their children. Daycare Areas : Living Room, Dining Room, and Bathroom Off-limits Areas : Garage, Patio, Kitchen, and entire second level. All off-limits areas were equipped with child safety locks or a safety gate. The applicant understands that off-limits areas may not be used for childcare during business hours. The indoor daycare areas were observed to be clean and orderly. Adequate lighting and ventilation were present throughout the home, with no hazards that could threaten children's safety. The home was observed to have two first aid kits, functioning combo smoke and carbon monoxide detectors, and two 3a40bc fire extinguishers. The combo smoke and carbon monoxide detector in the living room was tested and functioning. Cleaning and hazardous materials were stored out of children's reach and secured with child safety locks. The bathroom was found clean and fully operational. The toilet and handwashing facility were well-kept, safe, and clean. The bathroom is equipped with appropriate toileting equipment and appropriate sanitation products. See Page 2 Page 2 The indoor area was arranged with toys, furniture, and educational materials for the children, without any walkers or bouncers present. Electrical outlets were observed with child safety covers. Sharp items, such as knives, were placed in the kitchen cabinet, inaccessible to the children, with a child safety gate at the kitchen\342\200\231s entrance. The applicant confirmed the absence of firearms or weapons on the premises. A child safety gate was observed at the stairs to the second level. The fireplace was covered with a protective screen and a child safety gate. The home is observed to have a diaper-changing station, sleeping mats, and a crib. LPAs reminded the applicant that firm mattresses must be covered with size-appropriate sheets and that there must be no loose articles or materials in the crib while the child sleeps. According to the applicant, the community swimming pool is two blocks away and enclosed by a fence. LPAs reminded the applicant that the swimming pool is off-limits to children. The applicant was reminded to conduct emergency disaster drills every six months and maintain records of such drills. The applicant was also reminded to keep the assigned cell phone at home during daycare hours. Applicant was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. The applicant provided proof of control of property. The applicant has not obtained a signed Property Owner/Landlord Consent form (LIC9149). Without this consent, the applicant understands that, once licensed, they can operate with a maximum capacity of 6 [or 12] children. If property owner/landlord consent is obtained in the future, the applicant is advised that a new Application for a Family Child Care Home License (LIC 279) must be submitted with a change of capacity fee of $25, to increase the capacity and provide care to 8 [or 14] children. LPAs reviewed with applicant the LIC 311D, Forms/Records to Keep In Your Family Child Care Homes, children\342\200\231s forms/records, facility forms/records, and information to be posted. Entrance Checklist was provided to the applicant. LPAs discussed the safe sleep regulations with applicant and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep , as an additional resource. LPAs also informed applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/ , and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. On this date, 10/16/2024, the California Attorney General - Megan\342\200\231s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ. Applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. To receive important licensed related information to licensed facilities, visit the CCLD Important Information website at https://www.cdss.ca.gov/inforesources/community-carelicensing/subscribe and select the Child Care option to receive email communication. See Page 4 Page 4 LPAs reminded the applicant to be present in the home and ensure that children in care are always supervised. When circumstances require the applicant to be temporarily absent from the home, the applicant shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours the facility provides care per day. LPAs reminded the applicant that any duly authorized officer, employee, or agent of the Department shall, upon presentation of proper identification, enter and inspect any place providing personal care, supervision, and services at any time, with or without advance notice, to secure compliance with, or to prevent a violation of, the regulations adopted by the Department governing family child care homes. LPAs reminded the applicant that once she is licensed of a large family day care home, she shall ensure that at least one person who has a current certificate in pediatric first aid and pediatric cardiopulmonary resuscitation is available at all times when children are present at the facility or when children are off-site for facility activities. LPAs discussed with the applicant that the capacity specified on the license shall be the maximum number of children for whom care may be provided at any one time. The applicant provided a written statement to the LPAs that she would like to temporarily downgrade to a small FCCH license until she receives fire clearance from the San Rafael Fire Department for a large FCCH license. LPAs will recommend a small FCCH license for the applicant. The license will take effect on 10/18/2024. LPAs will not recommend a large FCCH license for the applicant until the San Rafael Fire Department issues a fire clearance for the home, which is a requirement for a large FCCH.
