What the inspector wrote

An unannounced Case Management visit was made to the facility by Licensing Program Analyst (LPA) Robert Maciel to address an incident that was brought to attention of the Department during a complaint investigation. According to interviews with staff and adults conducted between 3/22/24 and 4/16/24, there was an unreported unusual incident that occurred sometime during the end of February 2024 and the beginning of March 2024 regarding day care children who were outside in the playground without adult supervision. Interviews reveal that staff who directly observed or later became aware of the incidents did not report it to the Department and did not submit a written incident report as required. The following deficiency is being cited (see LIC 809D). Appeal Rights were provided. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with Director, Pam Chiriboga.

    No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.This requirement is not met as evidenced by: Based on interviews, child 1 - 3 (C1-C3) were left outside during transition from the playground to indoors and without adult supervision which poses a potential health & safety risk to children in care.

    101212 ...during the operation of the child care center if any of the events specified in (d)(1) below, a report shall be made to the Department by… next working day... In addition, a written report…shall be submitted to the Department within seven days...(1)Events reported shall include the following: (C)Any unusual incident or child absence that threatens the physical or emotional health or safety of any child.This requirement was not met as evidenced by: Based on interview, staff who directly observed or later became aware of the incidents did not report it to the Department and did not submit a written incident report as required. This poses a potential health, safety or personal rights risk to persons in care.
