What the inspector wrote

A required - 3 year inspection was made to the facility by Licensing Program Analysts (LPA) Leticia Rosales-Meza. A review of staff records on 04/15/26 indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. There are currently three adults living in the home. During today’s inspection the home and grounds were toured. The licensee was supervising four infants, and operating within the licensed capacity and ratio requirements. No children were observed left in any parked vehicle. The facility’s operating hours are 12:00 AM to 11:59 PM, Monday–Sunday. The floor plan submitted by the licensee was reviewed and verified. The "off limits" areas of the home are the three bedrooms, and garage, and were made inaccessible by means of door knob slip covers, key locked doors. The home was clean and orderly, and was at a comfortable indoor temperature of 68 degrees Fahrenheit. There were safe toys and equipment available for children. There is a working telephone in the home. The licensee has current pediatric CPR and First Aid certification, which expire on 04/2026 for Licensee and assistant. The licensee's CA mandated reporter training certificate expires April 20, 2026. Items which could pose a danger to children (detergents, cleaning compounds, and medications) were stored out of the reach of children. Poisons are stored in the locked cabinet with a key lock in the garage. The fireplace in the living room is screened. The licensee stated the fire place is not during day care hours. There is a working smoke detector, carbon monoxide detector and fire extinguisher rated at least 2-A, 10:BC. The licensee has conducted an emergency drill within the past six months, most recent Fire drill was documented on 4/01/26 . The licensee stated there are no firearms and/or other dangerous weapons in the home, and none were observed during today's inspection. (Continue to LIC 809-C) The children use the back yard as the outdoor play area and it is fully fenced. No bodies of water were observed. Five children's (C1 and C5) records were reviewed at 3:05 PM; required emergency information was observed to be on file. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417.     All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility: Obtain a California clearance or a criminal record exemption as required by the Department This requirement was not met as evidenced by: Based on statements and records obtained which confirmed that multiple adults provided care to children at the facility on behalf of the Licensee, while the Licensee was absent. A $500.00 civil penalty applies.

    OPERATION OF A FAMILY CHILD CARE HOME

    The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. This requirement was not met as evidenced by: Based on statements and records obtained which confirmed the Licensee was absent from the facility more than 80% of the time during her daily hours of operation.
