What the inspector wrote

An annual continuation inspection was made to the facility today by Licensing Program Analyst (LPA) Robert Maciel. LPA met with Licensee, Ericka Macias Ballesteros (LS). LS was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. During the inspection the home was toured inside and outside. The licensee was supervising six children and operating within the licensed capacity and ratio requirements. The facility’s operating hours are 7:00 AM to 5:00 PM, Mon–Fri. The home was at a comfortable indoor temperature. The children in care have access to age-appropriate toys and equipment. There is a working telephone in the home. The floor plan submitted by the licensee was reviewed and verified. The off-limits areas of the home are the laundry room, the closet under the stairs, the front yard and the second floor which includes two bedrooms and one bathroom. The home appears to be clean and orderly and was at a comfortable indoor temperature. The licensee’s pediatric CPR and First Aid certifications were reviewed and expire on 7/11/26. The licensee has conducted an emergency drill within the past six months; last drill was documented on 9/5/25. The licensee stated there are no firearms and/or other dangerous weapons in the home and none were observed during today's inspection. The children use the backyard as the outdoor play area, and it is fully fenced. 5 children's records were reviewed which revealed that the child files for C1-C5 did not contain LIC282 affidavit regarding liability insurance forms. Facility and personnel files were reviewed and contained required records. Continued on LIC809-C. LS stated that she did not record sleep checks performed for infants in care. LPAs discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. The following violation(s) of the California Code of Regulations, Title 22; Division 12, were observed: see LIC 809D. Appeal Rights were provided. A notice of site visit was given to Licensee and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Exit interview conducted and report was reviewed with the licensee Ericka Macias Ballesteros.
