What the inspector wrote

On 10/25/22 Licensing Program Analyst (LPA) Joseph Pacheco arrived at the facility to conduct an unannounced case management inspection. LPA met with Coordinator, Manisha Khosla. LPA toured the facility and a census was taken. The purpose of today's inspection was regarding an unusual incident that was reported to the Fresno Childcare Regional Office on 9/22/22. On 9/21/22 facility reported that Classroom #1 was transitioning from outside play to inside the classroom when it was discovered that Child #1 was left outside. As Classroom #1 was coming inside, Classroom #2 was going outside. Staff in Classroom #2 observed Child #1 on the play structure and immediately informed staff in Classroom #1. Staff #1 estimates that Child #1 was outside alone for under 10 seconds. LPA discussed facilities procedures with Coordinator and Staff #1 for transitioning children from outside to inside and vice versa. LPA reviewed the facilities daily activity schedule and observed the outdoor play area during today\342\200\231s inspection. This facility only provides care to preschool aged children and has exclusive use of the outdoor play area. Child #1's authorized representative was notified. Coordinator conducted a Staff Meeting on 9/27/22 where policies and procedures were reviewed and revised to ensure visual supervision of children is maintained at all times. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiency is being cited: (see next page, 809 D). Licensee was provided a copy of their appeal rights. Exit interview conducted and report was reviewed with Coordinator, Manisha Khosla. This report shall be made available to the public upon request. A notice of site visit was given and must remain posted for 30 days.

    Responsibility for Providing Care and Supervision. No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by information obtained during interviews. Interviews indicated that Child #1 was left unsupervised in the outdoor play area for under 10 seconds as Classroom #1 was transitioning from outside to inside at the same time Classroom #2 was transitioning from inside to outside. This poses a potential risk to the health, safety or personal rights of children in care.
