What the inspector wrote

On 07/07/2023, Licensing Program Analyst (LPA) Ka Vang conducted an unannounced case management inspection to clear the Plan of Correction. LPA met with Facility Representative Paula Smith and a tour the facility was conducted. LPA observed the facility is currently closed due to the daycare children are on summer break; however, staff was present. On 03/02/2023, this facility was cited for a deficiency of Type B as licensee did not comply with the regulation HSC 1597.16(a)(1); A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. Licensee did not provided Community Care Licensing with evidence of testing the water used for drinking or food preparation for lead contamination as required, therefore facility is out of compliance which poses a potential health, safety or personal rights risk to persons in care. On 07/07/2023, LPA conducted a tour of the kitchen and observed licensee is in compliance with the deficiency cited above as the facility conducted a lead water testing and the results indicated that one faucet (Faucet B-use for cooking) shows an ALE of 190 ppb. Licensee provided proof of correction which the faucet was permanently removed; therefore, children will not have access. The deficiency was cleared by an unannounced visit. Per the California Code of Regulations, Title 22, Division 12, Chapter 1, no deficiency was cited during today’s inspection. Facility Representative Paula Smith was provided a copy of appeal rights.
