What the inspector wrote

On 11/03/2025, Licensing Program Analyst (LPA) Ka Vang conducted an unannounced Case Management-Incident and was met by Susan Camago, Site Supervisor. A complete file review was conducted prior to today’s inspection. LPA toured the facility, and a census was taken. On 10/23/2025, an unusual incident was reported to the Community Care Licensing Office (CCL)-Fresno regarding an unusual incident occurred on 10/23/2025, at 09:20 a.m. inside classroom #3. The purpose of this Case Management-Incident inspection was to follow-up and investigate this incident, where Child #1 (C1)’s personal rights were being violated. According to the report received, on 10/23/2025 at 09:20 a.m., Atwater Elementary Special Education Personnel staff member (S1) was observed to be working with C1 but step away to assist another group of children. Meanwhile, Staff #3 went to the classroom utility closet to retrieve a broom and dust pan to clean the classroom floor. As S1came back from assisting the children, S1 observed C1 who S1 was working with was present in the classroom. Staff #2 (S2) meanwhile supervising four children in the blocks corner, and Staff #3 was cleaning the floor. As S1 announced the missing of C1 inside the classroom, Staff #4 (S4) walked into the classroom to assist in the classroom so that S3 could take S3’s break. All staff members observed to be actively searching for C1’s whereabouts. Per interviews, within three to five minutes, staff members could not locate C1 inside the classroom. As staff members were searching for C1, S3 then went to the utility closet to return the broom and dust pan, S3 discovered that C1 was standing inside the utility closet with a toy in hand. Per interview, it was confirmed that C1 entered the utility closet when S3 opened the utility closet to retrieve the broom and dust pan. (Continued on LIC809-C). Interviews and observation concluded that C1 could have not open the utility closet by C1 self as the door has a child’s safety door knob cover. The interviews confirmed that C1 walked into the closet as S3 was retrieving the broom and dust pan but S3 did not observed C1 walked behind entering the utlity closet. It was confirmed that C1 has not left the premises and C1 did not have access to any chemical, poisons, detergents, cleaning compounds, medication, or other hazardous items as the classroom utility closet was utilized as a storage area for the children’s unused small toys and blocks, children’s personal items, classroom materials, such as books, construction papers, arts and crafts items. During this unannounced inspection, LPA conducted interviews and observation and it was determined that C1 had accessed to the off-limits utility closet due to the lack of supervision. Based on this inspection, it was determined that C1’s personal rights were being violated due to lack of supervision. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, there is deficiency being cited during today’s inspection. (See page LIC809-D for additional information). Site Supervisor was provided with a copy of appeal rights on 11/04/2025. A notice of site visit (LIC 9213) was given on 11/04/2025 and must remain posted for 30 days. This report shall be made available to the public upon request. Exit interview conducted and report was reviewed with Site Supervisor.
