What the inspector wrote

On 03/05/2026, Licensing Program Analysts (LPAs) Ka Vang and Sha Fee Vang met with Site Supervisor Maria Rose Martinez for an unannounced Case Management-Incident inspection. A complete file review was conducted prior to today’s inspection. LPAs toured the facility, and a census was taken. An Unusual Incident Report (LIC 624) was submitted to the Fresno Community Care Licensing Office (CCL) on 02/25/2026 regarding an incident that occurred on 02/23/2026. According to the report, Staff #1 (S1) observed Child #1 (C1) visibly upset, after which C1 pulled Child #2’s (C2) hair. S1 then redirected C1 by picking C1 up, carrying C1 across the classroom to the carpet area, and restraining C1 by placing S1’s arms around C1 while C1 attempted to get away from S1. The purpose of today’s inspection was to investigate the incident. During this investigation, LPAs conducted observations of the classroom, and facility records were reviewed. LPAs also conducted interview with daycare children and staff members who were presented when the incident occurred. Based on the investigation and information gathered, there was no evidence indicating that C1’s personal rights were violated. Evidence showed that S1 appropriately picked up C1 from the carpet area by supporting C1 under the armpits with both hands in order to move C1 to the storytelling chair. It was further confirmed that S1 was attempting to prevent C1 from further harming C2 or other children by having C1 sit on S1’s lap. While seated, C1 became upset and began kicking. S1 informed C1 that it was not acceptable to hurt other children. As C1 continued kicking toward nearby children, S1 prevented further contact by placing her hand on C1’s feet while using the other hand on C1’s mid-back to provide support so that C1 would not fall. (Continued on LIC809-C). Additionally, while C1 was upset and moving, C1 inadvertently pulled S1’s necklace, which startled S1 and briefly caused S1 to hold onto the necklace. During this incident, it was confirmed that the matter resulted from a misunderstanding. Staff were provided with de-escalation strategy resources and were reminded that staff may not hold a child at any time. Per Title 22, Division 12, Chapter 1 of the California Code of Regulations, no deficiency is being cited during today’s inspection. An exit interview was conducted, and the report was reviewed with Maria Rosie Martinez, Site Supervisor. Maria was provided with appeal rights. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit was provided and is required to be posted for 30 days.
