What the inspector wrote

On 01/05/2023, Licensing Program Analyst (LPA) Ka Vang conducted an unannounced case management inspection. LPA met with Supervisor Roberta Heredia and Site Supervisor Andrea Ceja Martinez. LPA toured the facility inside and outside, and a census was taken. The purpose of today unannounced inspection was to conclude the complaint investigation that initiated on 12/08/2022 regarding facility staff threw water at a day care child’s face. During the inspection investigation on 12/08/2022, LPA interviewed facility staff and other who have knowledge of the investigation and it was disclosed that Reference #1 (Ref. #1) also used the electric leaf blower (HART 40v) to blow leaves and other debris toward daycare children during recess. When Ref. #1 blow the leaves and other ground debris toward the daycare children, it was observed that their hair was “flying”. During the interview, LPA observed the electric leaf blower (HART 40v) inside the site supervisor office. With blowing leaves and other debris toward daycare children posed a health, safety, or personal rights risk to children in care. A deficiency of Type B was issued as part of the Complaint (04-CC-20221205130658) due to the same Personal Rights violation. Licensee was provided a copy of appeal rights. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted with the Supervisor Roberta Heredia and Sit Supervisor Andrea Ceja Martinez.

    101223 Personal Rights. (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. Based on observation and interview, it was determinate that Ref #1 threw water at Ref #2 during recess break in the daycare playground. Ref. #1 also used the electric leaf blower (HART 40v) to blow leaves and other debris toward daycare children during recess which posed a health, safety, or personal rights risk to children in care.
