What the inspector wrote

On 01/31/2024, Licensing Program Analyst (LPA) Ka Vang conducted an unannounced Case Management - Other inspection and met with Licensee Juan Gama. Also, present was Site Supervisor Andrea Ceja Martinez. The purpose of inspection was to follow up on a previous complaint investigation which was conducted on 12/12/2023. LPA toured the facility, and a census was taken in each classroom. During the investigation inspection tour of the facility, LPA observed Staff #1 (S1) was in the Pre-Kindergarten Classroom and providing care and supervision for 12 children. LPA reviewed facility record and S1 did not have background clearance or exemption associated to this facility; however, LPA verified through the Department that S1 is currently fingerprint cleared through an exemption associated with another facility. This facility did not have S1’s record of fingerprint cleared associated with their facility. S1 disclosed that S1 had been employed with this facility since 01/02/2024. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, there is a deficiency been cited during today’s inspection. (See page LIC809-D for additional information). Licensee was provided a copy of appeal rights. A notice of site visit (LIC 9213) was given and must remain posted for 30 days. This report shall be made available to the public upon request. Exit interview conducted and report was reviewed with Licensee and Site Supervisor.

During today's Case Management inspection, Licensing Program Analyst (LPA) observe Staff #1 (S1) was providing care and supervision to 12 children in the classroom. Per record reviewed and staff interviewed, S1 has been providing and care supervision to children without fingerprint clearance or exemption associated to this facility since of 01/02/2024, which poses a potential health, safety and or personal rights risk to children in care.
