(4) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by: Based on interviews, it was determined that licensee and Assistants have been placing children on timeouts by making children sit on the carpet cross legged, with their hands behind their backs, and their heads bowed as part of their discipline. This poses as a potential risk to the health, safety, or personal rights of children in care.

Based on interview, and record review, the licensee did not comply with the section cited above, which poses an immediate health, safety or personal rights risk to persons in care.Licensing Program Analyst (LPA) observed that an adult in the home was not live scanned as it had been several months since he turned 18. LPA discussed the importance of ensuring that any adult children who reside in the home are live scanned within a month after turning 18 in order to be in compliance and for the safety of the children.
