What the inspector wrote

On 01/15/2026, Licensing Program Analyst (LPA), Ka Vang conducted an unannounced Annual Random Inspection and was met by licensee Magali Guevara-Espinoza. Also present in the daycare home was licensee\342\200\231s assistants. Licensee confirmed that the facility operates Monday through Friday, from 7:30 a.m. to 4:30 p.m. The home has a working telephone service, and LPA confirmed the phone number. LPA conducted a tour of the home, both inside and outside, and took a census of the children present. Capacity as specified on the license is being maintained. This is a single level home with no stairs. LPA reviewed the current facility sketch and confirmed that the living room, the kitchen, dining room, and hallway restroom are designated for child care areas and are accessible to children. LPA observed that Room #3 is no longer accessible to the children in care as licensee confirmed and installed a doorknob spinner so that children have no access to the off-limits Room #3. All other rooms in the home are also off-limits and made inaccessible as doorknob spinners were installed. Safe toys and age-appropriate play equipment were observed. LPA observed a built-in in-ground swimming pool in the backyard; however, the pool enclosure does not meet regulatory requirements. LPA observed that there are two windows and a door that provided direct access to the pool. LPA observed that the in-ground pool enclosed by a metal fence measuring 64 inches in height. The gate is self-latching, self-closing, and opens away from the pool, meeting regulatory requirements. The swimming pool is equipped with the following safety features: a minimum 12-foot rescue hook, a 20-inch United States Coast Guard (USCG)-approved life ring, a pool alarm compliant with ASTM F2208, and a daily Swimming Pool inspection log. (Continued on LIC809-C). Due to there are windows and door provided direct access to the pool area, a Type A deficiency was cited during today\342\200\231s inspection. A $500 civil penalty was assessed for failure to comply with pool safety regulations. Licensees confirmed that there are no firearms on the premises. All poisons are kept in a locked storage area, and no poisons were observed during the inspection. Detergents, cleaning compounds, medications, and other hazardous items were observed to be made inaccessible to children. LPA did not observe any fireplaces located in the home. LPA also did not observe any open-face heaters in the daycare area. LPA observed a working fire extinguisher, smoke detector, and carbon monoxide detector. The home has adequate heating and ventilation for the safety and comfort of children in care. LPA observed that the fire and disaster drills have been conducted and documented every six months, including the date, time, and number of children present. Licensee ensures that children in care are supervised at all times and acknowledge that children shall never be left unattended in parked vehicles. The outdoor play area located in the backyard is fully fenced. LPA reviewed a sample of children\342\200\231s files and observed that each file was complete with the required emergency information. Licensee\342\200\231s Mandated Reporter Training was completed on 08/20/2024. Licensee\342\200\231s pediatric CPR/First Aid certification is valid until 08/17/2026. A review of staff records indicates that licensee and all her employees have immunization records on file for influenza, pertussis, and measles, as required. LPA discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to resources such as forms, regulations Provider Information Notices (PINs), and Quarterly Updates. LPA discussed Reporting Requirements as outlined in the regulations (Section 102416.2) with licensee. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in the Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. (Continued on LIC809-C) LPA discussed safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA Ka Vang informed licensee Magali Guevara-Espinoza that this report dated 01/15/2026 documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed the licensee to provide a copy of this licensing report dated 01/15/2026 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 Acknowledgement of Receipt of Licensing Reports was given to licensee. Exit interview conducted and report was reviewed with licensee. During the exit interview, licensee confirmed that there are no Registered Sex Offenders (RSO) living in the facility and LPA verified the RSO profile in FAS. Licensee was provided with appeal rights. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.
