CRIMINAL RECORD CLEARANCE

(d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department or This requirement is not met as evidenced by:Based on observation the licensee did not comply with the section cited above. During the unannounced Case Management-Other (90 Days Visit), LPA observed Staff #2 (S2) and Staff #3 (S3) were providing daycare supervision for six daycare children. Staff #2 stated that Licensee left at 9:30 AM to a private appointment; therefore, S2 and S3 providing care for the daycare children. Both S2 and S3 confirmed that they have provided supervision care to Licensee “whenever she has appointments.” Having an uncleared adults in the daycare home poses an immediate health, safety, or personal rights risk to children in care.

(a) Prior to making alterations or additions to a family child care home or grounds, the licensee shall notify the Department of the proposed changed, including, but not limited to, the following: (6) Any change from an area of the family child care home previously identified as "off limits" to an area where care and supervision will be provided to children in care. This requirement is not met as evidenced by:Based on observation, the licensee did not comply with the section cited above. LPA observed that the off-limit area was being used for day care children which posed a potential health, safety, or personal rights risk to children in care.
