What the inspector wrote

On 03/28/2023, the Regional Office received a complaint report alleging #1 facility gate is in disrepair and #2 staff does not post food menu. Complainant stated the Director was aware the entrance gate to the facility had been nonfunctional for two weeks without repair. Complainant also stated that the facility does not post their snack menu’s for families to view. During today’s inspection, LPA Castanon and LPA Silva interviewed Director. LPA’s also obtained a copy of the children's roster, personnel report, and electronic application global announcements and reviewed one staff file. LPA’s observed the entrance gate had been repaired with a new latch. Director states the gate became faulty on 03/29/2023 and latched was replaced on 03/30/2023. Director has an appointment with the gate repair company for a quote to install additional security gates for safety. LPA’s also observed notices hanging on the gate via zip ties. The snack menu for the month of March was hung but April was not. Director was able to provide screenshots of announcements to parents regarding the April menu’s but upon further review, the dates were incorrect. Director was informed the menu needs to be edited, resent and posted. LPA’s did not observe a licensing board with required notices accessible for parents to view. Director stated it was temporarily removed because the documents were damaged by the recent weather. During the visit, Director was able to fix the board and place it near the entrance gate. Based on LPA’s observations, interview with Director and record review, the preponderance of evidence standard has been met, therefore the above allegations #1 facility gate is in disrepair and #2 staff does not post food menu is found to be substantiated. California Code of Regulations, Title 22, Division 12, 101238(a) Buildings and Grounds, as well as, 101227(6) Food Services are being cited on the attached LIC9099D. Exit interview was conducted with Director Cynthia Greenspan. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. End of Report

This poses a potential risk to the health and safety of the children in care.

    101238 Buildings and Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. This requirement was not met as evidenced by: Based on LPA's observation and interview with Director. The entrance gate was faulty due to wear and tear on 03/29/2023. This poses a potential risk to the safety of the children in care.
