What the inspector wrote

An unannounced case management inspection was conducted on this date by Licensing Program Analyst (LPA), Cindy Nguyen in response to a self-reported incident dated 03/20/25. Present during today\342\200\231s inspection was the Director, Melida Toscano, who accompanied LPA on a tour of the facility. Census was taken as follow: 5 toddlers, 46 preschool children with 9 staff members. A review of staff criminal records indicates all facility staff or individuals who require caregiver background checks have received a criminal record clearance or exemption and a child abuse index clearance. On 03/20/2025 an Unusual Incident Report was filed with the Department to self-report an incident that occurred on 03/11/2025. Director called to inform that Adult #1 (A1) stated Child #1 (C1) received a small scrape on C1\342\200\231s back. A1 stated C1 briefly mentioned that either Staff #1 or Staff #2 had pinched the child. LPA received copy of unusual incident report on 03/21/2025, a photo of C1\342\200\231s back and two LIC 855 declarations dated 03/24/2025. The interview and declaration from S1 stated that S1 wasn\342\200\231t in that classroom on that day and at that time. The interview and declaration from S2 stated between approximately 10:00 -10:30 AM, S2 observed C1 actively engaged in rough play with his peers. C1 was dropping to the floor on his back and stomach. During playtime, C1 approached S2 and mentioned that C1\342\200\231s back felt slightly sore but did not display any signs of distress or injury. S2 checked and didn\342\200\231t notice any marks on C1 at the time. S1 and S2 both stated their dedication to the children and firmly stated that they would never pinch a child. Director reviewed the video footage from 03/11/2025, which confirmed that no teacher was involved in any inappropriate physical with C1. The video footage also verified that S1 was never in the classroom during that time. The video footage showed C1 actively in the class and throwing himself onto the floor while playing with his friends. Continued on Page LIC 809-C Page LIC 809-C LPA Nguyen contacted Adult #1, A1 stated that A1 doesn\342\200\231t believe the staff pinch the child, however A1 just want to make sure the staff are watching the children since there wasn\342\200\231t any incident report on that day. C1 is still attending the daycare and they are happy with how the facility handle this situation. Based on the interviews, the photo, declarations reviewed, and observation during today\342\200\231s inspection, no deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the inspection. Exit interview was conducted with Director Melida Toscano. The Notice of Site Visit was posted. Director was informed that the Notice of Site Visit must be posted for 30 consecutive days.
