What the inspector wrote

On 11/03/2025 a complaint was filed with the Licensing office stating, Staff wrongfully terminated day care child. During the course of investigation, LPA interviewed 3 staff members and 3 parents. During the staff interviews, 3 out of 3 staff stated they have not witnessed a child being wrongfully terminated. Staff 1 (S1) stated the way staff deal with challenging behaviors is staff talk to the children, separate the child, talk to the child about their feelings, help them to self-regulate, and staff never yell. Since the day Child #1 (C1) started, every single day there was an incident, staff tried many things, new action plans, and different options, but C1 was still acting out. All incidents were communicated to the parent on the BrightWheel app, and S1 and Staff #2 (S2) reported C1\342\200\231s behavior to Staff #3 (S3). Children complained to their parents, parents started to have concerns, and C1 would hurt children who were near, so staff tried to create space. S1 does not believe any child was wrongfully terminated and stated C1 needed more help than staff can provide, and staff did not see evidence that additional help was coming. Staff #2 (S2) stated challenging behaviors are addressed by verbal warnings, reminders for kind hands, breaks, office support, and documentation on BrightWheel. S2 met with the parent, observed aggressive behaviors, stated the behavior was getting more aggressive, and believes C1 was not wrongfully terminated and that the family was given many chances. Staff #3 (S3) stated staff redirect the child, provide resources and sensory activities, document behaviors, communicate with parents, and after extensive efforts, escalating aggression and complaints from other families required protecting the safety of other children. 3 of 4 parents were interviewed, 3 of 3 parents interviewed had no issues or concerns with the daycare. LPA obtained a copy of the Children\342\200\231s Roster, Personnel Report, Parent Handbook and Classroom attendance enrollment sheets. LPA also received copies of screenshots from BrightWheel that included incident/ouch reports, email correspondence between director and parent. A copy of child #1's physician's report and subsidy program contract. LPA received a copy of email correspondence between Director and Facility's administration. Upon reviewing the Parent Handbook, their policy on \342\200\234Challenging Behaviors\342\200\235 states \342\200\234\342\200\246continued aggressive behavior may result in the child\342\200\231s termination in the program.\342\200\235 Page 2 of 3 Based on LPA\342\200\231s interviews and record review, there is insufficient evidence to corroborate the allegation of Staff wrongfully terminated day care child . Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur; therefore, the allegation is UNSUBSTANTIATED. Exit interview was conducted, and report was reviewed and discussed with Director, Melly Toscano. Notice of Site Visit was posted during the visit. The facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. The facility was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights. End of Report. Page 3 of 3. End of Report.
