Page 2 The facility representative self-reported this incident to Regional Office on 04/20/2022. This case was assigned to Investigator Ernestina Bellucco, from Investigations Branch (IB) with the Department. Investigator Bellucco obtained police report, CPS report, children’s roster, sign in-out forms, and conducted interviews. Per investigator Bellucco, Orange County Sheriff investigator stated child was interviewed by OC Sheriff Deputy who stated, and the child did not disclose any misconduct by the alleged Parent. IB interviewed the child’s pediatrician and noted the child was taken for a routine medical appointment by the child’s parents. During visit, one of the parents disclosed to pediatrician the child’s statement about being touched inappropriately after using the restroom by one of the male parents at the school. The pediatrician completed a physical examination and questioned the child. The child did not disclose any identify only stated that it tickled when she was wiped. The pediatrician stated there were no medical concerns or any physical findings on the child. Police report indicates the accused parent denied any misconduct and reported not assisting children other than their own when volunteered at the school. Orange County Sheriff Investigator informed investigator Bellucco the child had a forensic interview conducted on 05/10/2022. Based on the investigative report, the child did not disclose any information determined to be inappropriate and provided inconsistent statements. The Sheriff’s Department closed the case due to lack of corroborating evidence. Licensing Program Analyst (LPA) Malek attempted to interview 6 parents and 6 children. Due to the facility being closed for the Summer, additional interviews with children and parents were unsuccessful as only 1 of the 6 parents responded. No disclosures were made by the parent or child. Continue to page 3. Page 3 Based on the information gathered during the course of investigation by IB Investigator, supportive investigative reports from the Orange County Sheriff’s Department, and LPA’s review, there is not enough proof to support the allegation of a parent inappropriately touched a child while using the restroom. This agency has investigated the personal rights complaint allegation, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove, the alleged violation did or did not occur, therefore the allegation is unsubstantiated. The director was provided a copy of their appeal right (LIC 9058) and their signature on this form acknowledges receipt of these rights. Exit interview was conducted with director, Cori Preisler.
