What the inspector wrote

Page 2 During the investigation LPA Odom interviewed complaining party, Director, 7 staff members, and 5 children. LPA reviewed the Children’s Roster, personnel report, and personnel records. During an interview on 7/11/2022, the Director (S8) stated they recently became the director for the childcare center as of April 2022. They have not observed S3 yell at children or shaming children. If a child is misbehaving or not listening each classroom has a “calming corner” where there are books, puzzles and a place where the child can relax until they feel ready to return with the rest of the children. The childcare center does not use time-out, but they are aware all of the staff have not adapted the new discipline policies which are SEL (Social, Emotional, Learning) process. S8 stated they are working on scheduling a retraining session on SEL for all staff. LPA Odom interviewed seven staff members on 7/11/2022 and 8/11/2022. Three out of seven staff have observed S3 being rude to children and staff. Staff #5 (S5) stated S3 has been observed to speak to the children in a rude and demanding tone of voice. There was one time when S5 confronted S3 and told them not to speak to the children in that manner. In response S3 was rude to S5. S5 told Staff #4 (S4) but they don’t know if anything was done. Staff #6 (S6) stated they were in the co-classroom next to S3’s classroom and they could hear S3 yell at Child #7 (C7) and Child #8 (C8) and a few other children. S6 related S3 would become aggravated very easily and did not have patients. S6 disclosed there were multiple times children were sitting on time out next to S3 in the classroom. S6 stated they informed the previous director and told S6 they were going to provide additional training to S3. Staff #7 (S7) stated during outdoor play they observed S3 use a mean tone of voice to C8. S3 told C8 “I don’t like you, you’re not nice” and had C8 on time out for 10 minutes. S7 stated they told the previous director. S3 denied telling a childcare child “your acting like a baby”. S3 stated they don’t use time out only common areas to calm their bodies. LPA Odom interviewed 8 children on 7/11/22, 7/20/2022 and 8/8/2022. During the interviews, C7 and C8 disclosed they have been placed on time out multiple times by S3. C8 disclosed S3 has yelled at C8 and another child. Two other children disclosed they use the corner where they have books and puzzles when they don’t listen. Continue to page 3. Page 3 Based on LPA facility inspection, observation, interviews conducted with complainant party, director, staff members, children and records reviewed it has been determined that S3 does not treat daycare children with dignity and respect. Therefore, the preponderance of evidence standard has been met, the allegations are found to be Substantiated. California Code of Regulations, Title 22, 101223(a)(3) Personal Rights is being cited on the attached LIC 9099D. This report cites a Type A violation and shall be provided to parents/guardians of children currently in enrolled and to parents/guardians of children newly enrolled at the facility during the next 12 months. Parents/guardians must sign Form LIC9224 to be kept in each child's file. Exit interview was conducted with Director Rebekah Bat. Director would like to be referred to the Technical Support Program (TSP) for consultation. Notice of Site Visit was posted during the visit, failure to post will result in civil penalties of $100. Appeal rights were provided and explained.
