What the inspector wrote

page 2 Specifically, that a child had been saying that a friend "touches and tickles his butt." The investigation consisted of interviews with 5 parents, 6 out of 6 children were qualified knowing difference between truth and a lie. LPA interviewed three staff who directly provide care and supervision for the children in the room that the incident allegedly occurred. The following was found: Interview with parents did not divulge any information regarding the allegation. LPA interviewed 6 qualified children and none of the children interviewed stated that a friend has tickled their butt or that they have tickled a friend's LPA interviewed three staff for the age group specified, all three staff had never observed any child tickle another child's butt. LPA was unable to corroborate the allegation that lack of supervision resulted in inappropriate touching between children. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated . An exit interview was conducted with Director Bay. Appeal Rights were explained. The Director was provided a copy of appeal rights (LIC 9058) 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the Regional Manager to the address listed. The Notice of Site Visit was given and discussed it must be posted as required by H & S Code Sec. 1596.817. Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.00.
