What the inspector wrote

On 8/22/2025 the Orange County Child Care Office received a complaint alleging (1) Facility is operating out of ratio. Reporting Party (RP) stated the following: every day since the school on 8/19/2025, the preschool classroom has had 19 children to one staff. The principal stated when enrollment reaches 20 children, the principal will hire another staff member. During the investigation, LPA interviewed 3 staff members including the principal and 4 children. 3 out of 3 staff members stated they have not been out of ratio. LPA obtained copies of the children’s roster and sign in/out sheets. The children’s rosters stated they have 16 children enrolled. On 8/26/25, LPA observed 16 children’s names in the sign in/out binder that was located by the entrance door. LPA was able to interview 3 parents, and the 3 parents did not disclose any concerns regarding the allegation. Based on information gathered from LPA’s interviews with the 3 staff members, 3 parents and record review, the preponderance of evidence has not been met. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations (1) Facility is operating out of ratio is; therefore, the allegations are UNSUBSTANTIATED. Exit interview was conducted. Notice of Site Visit was posted during the visit. Facility representative was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Appeal Rights were explained. The Principal was provided with a copy of the appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above. The Reporting Party (RP) stated the following: Staff#1 (S1) comes in and out of the classrooms when teachers need breaks or lunches, but S1 is not a permanent staff and does not meet the requirements to be supervising children alone. During the investigation, LPA interviewed 3 staff members including the principal and 4 children. On 8/26/25, when LPA arrived at the facility. LPA observed S1 alone with children in classroom Prek2. Staff#2 (S2) stated that S1 has been alone with the children when S2 is on break. LPA reviewed S1’s file and it was determined that S1 does not have the qualifications to be alone with the children. The 4 children that were interviewed did not disclose any concerns regarding the allegation. LPA was able to interview 3 parents, and the 3 parents did not disclose any concerns regarding the allegation. Based on information gathered from LPA’s 3 staff interviews, observation, record review, 4 children’s interviews, and 3 parent interviews, the preponderance of evidence has been met; therefore, the allegation of (1) Unqualified staff are supervision children is SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, Section 101216.1(c)(1) Teacher Qualifications and Duties is being cited on the attached LIC9099D. Please refer to attached 9099D for documentation of deficiencies. Exit interview was conducted with Principal, Rosaura Ramirez. Notice of Site Visit was posted during the visit. This poses a potential health and safety risk to the children in care.

    1596.885(c)H&S- Conduct Inimical - conduct which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility or the people of this state.This requirement is not met as evidenced by: Based on LPAs observations and staff interviews, the facility moved children to classroom Prek2 due to LPA being present and the principal stated that the principal covers breaks for staff members which does not occur. This poses a potential health and safety risk to the children in care.

  • TEACHER QUALIFICATIONS AND DUTIES

    (c) To be a fully qualified teacher, a teacher shall have one of the following: (1) Twelve postsecondary semester or equivalent quarter units in early childhood education or child development completed, with passing grades, at an accredited or approved college or university…This requirement is not met as evidenced by: Based on staff interviews, observation, and record review, the facility did not comply with the section cited above in S1 has been a left alone with the children and does not have the qualifications which poses/posed a potential health, safety or personal rights risk to persons in care.
