What the inspector wrote

Licensing Program Analyst (LPA) A. Nunez conducted a Case Management – Deficiencies due to deficiencies observed during a visit on 8/26/2025. LPA informed Principal Rosaura Ramirez for the purpose of the Case Management. A review of the Facility Personnel Report Summary shows all facility staff or individuals who require caregiver background checks have received a criminal record clearance and a child abuse index clearance or an exemption clearance. The census was 5 children with 1 staff member. On 8/26/2025, at 9:24am LPA went to the classrooms to take census and observed 8 children with 1 staff member in the Prek1 classroom. LPA observed children and a staff member in classroom Prek 2. The front office staff members stated the children in the Prek2 classroom were Transitional Preschoolers. It was later determined that the 7 children that were in classroom Prek 2 did belong in classroom Prek1 that is part of the licensing program. LPA interviewed 4 children and 4 out 4 children stated their classroom is in Prek1. 4 out of 4 children also stated they have nap in classroom Prek 2. Classroom Prek 2 is not part of the facility’s license. 2 out of 2 staff members also stated they have 16 children enrolled in the program. LPA reviewed the children’s roster and observed 16 children in the roster. Prek1 classroom is only licensed for 15 children. The facility was not in compliance with California Code of Regulations, Title 22, Division 12 & Chapter 1, 101161(a) Limitations on Capacity and 1596.885(c)H&S- Conduct Inimical being cited; see LIC 809-D. Exit interview was conducted. The Notice of Site Visit was posted for no less than 30 consecutive days. Appeal Rights was explained. A copy of appeal rights (LIC 9058 1/16) was provided and their signatures on this form acknowledges receipt of these rights. First level appeal is to Regional Manager, address is above on the report.

    101161 Limitations on Capacity and Ambulatory Status (a) A licensee shall not operate a childcare center beyond the conditions and limitations specified on the license, including the capacity limitation.This requirement was not met evidenced by: Based on record review and staff interviews, the facility was using a room that was not licensed, and they have 16 children enrolled in their classroom. This poses a potential health and safety risk to the children in care.

    1596.885(c)H&S- Conduct Inimical - conduct which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility or the people of this state.This requirement is not met as evidenced by: Based on LPAs observations and staff interviews, the facility moved children to classroom Prek2 due to LPA being present and the principal stated that the principal covers breaks for staff members which does not occur. This poses a potential health and safety risk to the children in care.

    (c) To be a fully qualified teacher, a teacher shall have one of the following: (1) Twelve postsecondary semester or equivalent quarter units in early childhood education or child development completed, with passing grades, at an accredited or approved college or university…This requirement is not met as evidenced by: Based on staff interviews, observation, and record review, the facility did not comply with the section cited above in S1 has been a left alone with the children and does not have the qualifications which poses/posed a potential health, safety or personal rights risk to persons in care.
