What the inspector wrote

An unannounced case management report was initiated on this date by Licensing Program Analyst (LPA) Odom based on information discovered during a complaint investigation initiated on 6/28/22. Present today was Director Rebekah Bay, who greeted LPA upon arrival. During Facility Inspection LPA observed 7 infants and 5 staff. In the course of the investigation it was discovered that Director did not report Hand, Food, Mouth disease outbreak that occurred in the toddler classroom to licensing office within 24 hours and in writing within 7 days. LPA asked Director the reason why the incident was not reported, Director stated, they were not aware they had to report the incident and Administration would handle reporting the incident. LPA Odom spoke with staff #2 if they reported the incident and they were not aware of the reporting requirement regulations. Therefore, facility is being cited. California Code of Regulations, Title 22, Division 12, Chapter 1, Reporting Requirements 101212(d)(1)(E) d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (1) Events reported shall include the following: (E) Epidemic outbreaks. is being cited on the attached LIC 809D Exit interview was conducted. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above

    101238 Building and Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. This requirement is not met as evidenced by: Based on observations and interviews, staff do not wear booties inside the infant classroom, and facility was not properly disinfected in which it caused multiple cases of hand, foot, and mouth disease. This poses a potential health and safety of the children’s in care.

This requirement is not met as evidenced by: Based on interviews with staff, on 5/27/22 S4 was alone with 6 infants in the toddler room for 10 minutes. This poses an immediate risk to the health and safety of the children in care.

    101428 Infant Care Personal Services (b) The infant shall be kept clean and dry at all times. (2) Each infant's clothing and diapers shall be changed as often as necessary to ensure that the infant is clean and dry at all times. This requirement is not met as evidenced by: Based on observations, interviews and records reviewed S2 did not change the infant’s diapers with frequency to maintain a clean and dry diaper at all times, also causing for children’s diaper rash. This poses an immediate risk to the health and safety of the children in care.

  • REPORTING REQUIREMENTS

    Reporting Requirements 101212(d)(1)(C ): (d)(1) below, a report shall be made to the Dept by telephone… within the Department's next working day and during its normal business hours. In addition, a written report containing the information…within seven days following occurrence… (1)... This requirement was not met as evidenced by: Based on observations and interviews Director did not report the multiple cases of hand, foot, mouth disease that occurred in the infant center to licensing office or department of public health. This poses a potential risk to the health and safety to the children in care.
