Based on observation, the licensee did not comply with the section cited above in one count out of one count which poses a potential health, safety risk to persons in care. LPA observed the wooden bottom of the fences around playground had splinters and some nails sticking out of the wood. On another playground some dried bushes of tress piled up over the fence to create possible fire hazard.

101223 Personal Rights(a) The licensee shall ensure that each child is accorded the following personal rights:(2) To be accorded safe, healthful, and comfortable accommodations, furnishings, and equipment to meet his/her needs. The requirement was not met as evidenced by interviewing 7 staff and 7 children confirming child #1 (C1) has hurt them. There were 12 incident reports within 2 months indicated C1 has hurt other children and that the facility failed to prevent children from being hurt. This is an immediate risk to the health and safety of children in care.
