What the inspector wrote

On 02/05/2025 at 9:15am, Licensing Program Analyst (LPA) Sarah Garcia conducted a case management- incident visit in response to a self-reported unusual incident report (LIC 624) received on 01/10/25 regarding children\342\200\231s personal rights being violated. LPA met with director, Roxanne Chuong. A walk through of the facility was conducted, and census was taken. Total census was 16 preschool children and 2 staff. A review of staff criminal clearance records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. On 01/10/2025, a self-reported Unusual Incident Report (UIR) was filed with the Licensing Office. The facility reported that on 1/10/25 at approximately 4:15pm, upon reviewing video footage Staff 1 (S1) was rough with Child 1 (C1). C1 had knocked down a chair and refused to pick it up. S1 then scooted C1 to the chair to pick it up. C1 did not sustain injuries. S1 was written up. On 01/15/2025 parents were informed of the incident and parents viewed the video footage on 01/16/2025. During today's inspection, LPA Garcia interviewed 3 staff and attempted to interview 3 preschool children. LPA obtained C1's LIC 700, children's roster, and family handbook. LPA was unable to view video footage because per director the footage has expired. LPA Garcia was unable to interview Child 1 (C1) involved incident because they attends program on Thursday's and Friday's. Child 2 (C2), Child (C3), Child 4 (C4) did not qualify for an interview. Continued on Page 2 Page 2 During staff interviews, S1 stated "C1 tends to throw the chairs and throw themselves to the ground. C1 was throwing things at friends, and I approached them. C1 was upset and grabbed the chair and threw it on the floor. I was there and I told C1 calm down. I grabbed C1 on the back, and they tends to throw tantrums.. they threw themselves on the floor. " S1 stated, " I stayed there with C1 after that. C1 picked up the chair. I stayed with C1 once they was calm enough to go back to the group. " S2 made no disclosures regarding the incident. S3 stated, "C1 had thrown down, pushed down a chair.... S1 told him to pick up the chair because it could not be in the middle of the classroom. So, S1 scooted C1 in the chair. " When LPA asked staff about children with challenging behavior, 3 out of 3 staff stated they redirect, talk with the child, and allow the child time to collect themselves. When LPA asked staff if they have observed or experienced any child discipline by staff that was inappropriate, 3 out of 3 staff stated they have not observed that. LPA reviewed staff handbook and observed the facility practices the positive behavior support model which works to prevent challenging behavior. Teachers help children develop self-control and social skills by treating them with respect, fairness and consistency. Teachers model and coach appropriate behavior to children. Discipline such as hitting, pushing, pulling, and physical force is prohibited. Based on LPAs record review and interviews there was not enough evidence to determine violation of personal rights. No deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit. Exit interview conducted and report was reviewed with director, Roxanne Chuong. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
