What the inspector wrote

Page 2 During the investigation LPA Odom interviewed reporting party, director, 2 staff members, and 5 children. LPA conducted a facility inspection, reviewed the children’s roster, personnel report, childcare discipline policies, sign in and out sheets, and C1’s file. During the investigation, Director (S1) was interviewed on 07/15/22. S1 stated, the childcare discipline policies are time out by sitting on a chair away from the other children to give the child time to calm down. After a couple minutes staff will speak with child or redirect the child to a different activity. S1 stated C1 attended the childcare for about 2 weeks on and off. On 5/16/22 S1 had a conversation with RP regarding C1’s aggressive behavior with staff and other children. S1 disclosed on 5/17/22 S1 had a meeting with RP to review the childcare discipline policies that were signed by RP on 5/13/22 and S1 went over with RP how staff discipline C1 which are time-out and redirecting. S1 stated they have never observed Staff #2 (S2) yell or hit C1. During the investigation, 2 staff members were interviewed on 07/15/22. Both staff disclosed they use time-out when disciplining children by having the child sit on a chair away from the children for 1-2 minutes along with talking to the child at eye level and redirecting. S2 stated they had to put C1 on time out multiple times in one day for 20-30 seconds due child’s behavior. S2 disclosed they spoke with RP regarding C1’s behavior on more than one occasion because C1 hit S2 and C1’s aggressive behavior. S2 stated they never hit or yelled at C1. Staff #3 (S3) stated they don’t allow children to hit each other, if a child does hit another child, they are given time-out for 1-2 minutes, and ask the child to apologize to the other child. S3 stated they have never observed S2 yell or hit C1. LPA Odom attempted to interview C1 on multiple occasions RP was unable to confirm a date and time for a collateral visit, C1 no longer attends the childcare center. LPA interviewed 5 children on 07/15/22. All the children disclosed they get time out and sit on the chair in the classroom if they do not listen or behave and children did not disclose that they must face the wall during time out. None of the children disclosed that staff hit or yell at the children. Continue to page 3. Page 3 Based on LPA’s facility inspection, observations, interviews conducted with reporting party, director, 2 staff, 5 children and records reviewed it was determined there was insufficient evidence that staff hit C1, staff force C1 to sit on time all day, and staff allow children to hit each other. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated. Exit interview was conducted with Director Patricia Groton. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
