What the inspector wrote

During the course of investigation, LPA interviewed 5 staff members, subject child, 4 parents, and reviewed records. LPA interviewed 5 staff members. 5 out of 5 staff members stated they did not witness S1 handle day care child in a rough manner or making inappropriate comments towards a child in care. Personnel and Operation Director disclosed the following: On July 30 th , 2024, mom brought C1 into the facility and C1 did not want to stay so mom took C1 out to the car. S5 then informed director that they heard C1 said \342\200\234ouch, ouch\342\200\235 so director and S2 went to the car to check it out. When director was outside in the parking lot, director observed C1\342\200\231s half body was inside the car and C1\342\200\231s legs were dangling outside the car. Director went to the car, bent down, placed her hand on C1\342\200\231s knee, and asked C1 to sit down for mom. C1 turned their body on their own and sat down. Mom then asked if director touched and pushed C1. Mom also told director not to touch C1. Director told mom she did not push C1. Director then put her hand on mom\342\200\231s shoulder and said, \342\200\234I\342\200\231m just trying to help\342\200\235. Mom then said \342\200\234First, you put hands on my kid, then you put hands on me?\342\200\235 Director then decided to terminate C1\342\200\231s services as of 7/30/2024 due to the mom\342\200\231s behavior and the staff felt unsafe. Personnel and Operation Director contacted Cypress Police Department to inquire of a report regarding the incident and they stated there was no report taken. Staff #2 (S2) stated, director did not shove C1\342\200\231s leg inside the car. Director just placed her hands on C1\342\200\231s leg to get C1\342\200\231s leg inside the car. There was no struggle. C1 wasn\342\200\231t resisting and C1 was not crying. S2 did not witness director make inappropriate comment toward a child in care. S5 stated at no point did director shove C1\342\200\231s leg inside the car. Director squatted down and placed her hand on C1\342\200\231s leg to get C1\342\200\231s legs inside the car. S5 did not witness director make inappropriate comment toward a child in care. LPA interviewed C1 and C1 did not make any disclosures regarding the above allegations. LPA Duron interviewed 4 parents. All interviewed parents stated they did not have any concern with facility. LPA obtained and reviewed the police report. It was listed as \342\200\234Event\342\200\235 only. No police report was generated. Page 2 of 3 Based on the information gathered from LPAs\342\200\231 interviews, observation, and the reviewing of records, there is insufficient evidence to corroborate the allegations: Director handled day-care child in a rough manner. Director made inappropriate comments towards a child in care. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur in the day care facility, therefore the allegations are UNSUBSTANTIATED. An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department. The facility representative was informed that the \342\200\234Notice of Site Visit\342\200\235 must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The \342\200\234Notice of Site Visit\342\200\235 must be posted on or adjacent to the door. Page 3 of 3. End of Report.
