What the inspector wrote

On 4/12/24 the Orange County Child Care Office received a complaint alleging Facility roof is in disrepair. The Reporting Party (RP) stated the roof is leaking in the Bear room. RP stated they have seen black mold which they believe is due to the leak. RP stated that water drips from the roof through the ceiling when it rains, and the staff use a bucket on the floor to catch water. During the investigation, LPA Nunez inspected the classrooms, interviewed 4 staff members, and obtain copies of the children’s roster and an invoice and receipt of a water leak repair. The children were not interviewed due to age and being non-verbal. On 4/16/24 LPA interviewed 4 staff members. 3 out of 4 staff stated they have been in the bear classroom when it has rained. 3 out of 4 staff members stated there was a leakage in the bear room but got fixed. Staff#1 (S1) provided an invoice and receipt of the leak repair. 4 out of 4 staff members stated they have not seen mold inside the bear classroom. On 4/16/24, LPA observed the ceilings in the 3 classrooms and at that time did not observe any mold in the ceilings. S1 also stated they have replaced some of the ceiling tiles in the classrooms. On 5/3/24 LPA attempted to interview 6 parents however only 2 parents were available for interviews. None of the parents disclosed any concerns about the childcare center. The 2 parents were satisfied with the childcare center. Based on LPA’s observation, staff interviews, and parent interviews, the complaint alleging facility roof is in disrepair is found to be UNSUBSTIATED. Although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. Exit interview conducted and report was reviewed with Director Meredith Cagle. Notice of site visit was given and must remain posted for 30 days. Failure to comply with the posting requirements shall result in an immediate civil penalty of $100. Appeal Rights were explained. The Director was provided with a copy of the appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above. Page 2 of 2

(1) No child shall be left without the supervision of a teacher at any time, Supervision shall include visual observation. This requirement is not met as evidenced by: Based on LPA interviews staff did not observed how C1's finger was smashed. This poses an immediate Health and Safety risk to the children in care.
