What the inspector wrote

Licensing Program Analyst (LPA) Nguyen Tran conducted a case management inspection to follow up on a self-report unusual incident that was submitted to CCL Regional Licensing Office on 02/17/2023. It was reported by Dennisse Duenas, Director via fax. According to the Director, the unusual incident occurred on 01/26/2023. The Director reported the following: on 01/26/2023, staff #1 (S1) took Child #1( C1) and 2 other children to the bathroom since C1 had an accident and needed to change clothes. According to S1, C1 asked S1 to help pulling up C1's pants and S1 assisted C1 to pull C1's pants up. On 01/30/2023, Director had a meeting with C1's parent to address parent's concern about bathroom procedure. During the meeting, the parent shared concern that C1 disclosed that S1 touched C1's private part. Director explained bathroom policies and procedures to parent. Director also followed up with parent's concern on 02/02/2023. On 02/14/2023, La Habra PD Detective came to the facility to investigate since it was reported that C1 disclosed about S1 was touching C1's private area. During today's inspection a tour of the facility was conducted. There were 30 children and 6 staff members in 2 preschool classroom. A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances. (Continue next page) (Page 2 of Report) During the case management inspection on 02/24/2023, LPA Tran interviewed 6 staff members and 7 children. All interviewed staff gave consistent answer about bathroom procedure when staff always take more than 1 child to the bathroom, staff will inform Director and ask for help if there is a child that needs assistance in the bathroom. All interviewed staff denied of witnessing any staff taking only 1 child to the restroom. LPA Tran attempted to interview 8 children. Three out of 8 children were qualified for the interview. All 3 interviewed children stated teacher always take more than one child to the restroom and denied that they ever witnessed the teachers taking only 1 child to the restroom. LPA Tran also contacted 8 parents for an interview. 7 out of 8 contacted parents called back and provided good feedback about the facility and has no further concern. During record review, LPA Tran reviewed La Habra Police Report 23-004115, the police report finding was unable to establish that a crime was committed. Based on the information gathered from LPA's interviews and record review, there is no evidence to support any violation of Title 22 regulations. No Title 22 deficiencies cited during today's inspection. Exit interview was conducted. The Notice of Site Visit was posted. Director was advised the Notice of Site Visit must be posted for 30 days or 100$ Civil Penalty will be assessed. (End of Report)
